Fairbanks acquired my mortgage from Equicredit. During the transfer of servicing, 3 payments were somehow mis-posted. I received a letter from an attorney threatening foreclosure. To protect my credit, I paid the 3 payments, attorneys' fees, and ended up getting a refund from Equicredit later.

A few months ago, I got a demand letter from Fairbanks, stating that my loan was delinquent. I had missed one payment, but made it up the following month. Fairbanks returned both payments with a letter to call them for reinstatement. My payment is $341 / month, the reinstatement was over $1200. When questioned about the breakdown of reinstatement payments, over $600 of garbage fees were included, several corporate advance fees, inspection fees, other advance fees, and late fees. Obviously I owed the late fees.

When I asked if I could get on a repayment plan to pay their garbage fees, the operator said no. When I asked for a supervisor, the operator told me that if I did not like what she said, she would put me back in the phone system, I could hold for another 1/2 hour and tell my story to the next person to answer the phone. The operator refused to provide me with her name, a supervisor or the legal department. I telephoned back w other times on 9-27-02 and received the same treatment from each operator.

This company's employees are extremely rude, they yell, and the call every day for a payment if not made by the 5th of the month. When they reach you, they yell at you, threaten you with lawyers, foreclosure, and hang up on you.

Lori, You know what the saddest thing about your complaint is? I believe you. I am finding more and more businesses employing rude and obnoxious agents operating customer hotlines. I've heard tape recordings of the most hateful operators. Here's what I suggest--call them back and tape record the conversation. You live in Arizona; therefore you do not have to tell them you are recording. You can buy a tape recorder from Wal-Mart for less than $10. Radio Shack sells a device that hooks up to your telephone to make a clear recording. You can also use your answering machine if it has the right features. If you catch the meanies on tape call your local TV station and give them the tape. Take a copy of the tape to an attorney--I'll bet a jury would give you a little money. Who knows? Maybe we will all see you on 60 minutes or 20/20 on an investigative report. It's time the downtrodden start fighting back. Good Luck.
