Forster & Garbus LLP misleading abusive debt collector Commack New York
This is not a law firm, they are a debt collector. For me, this is on behalf of Fingerhut, and i had gotten behind in my payments but believed the debt had been sent to collection.
I called twice on the same day to arrange payment but they wouldn't take it unless i paid $200 now and $150 per month after. They continued to threaten legal action if i didn't pay the amounts they wanted. Yet, when i asked how they could do that if i was attempting to pay the debt, they said they could NOT advise me legally. So they're posing as attorneys. I'm not even sure the court summons they sent me is real and i will be visiting my local court where it is supposedly on file to find out.
Upon further investigation, my fingerhut account is still open and i can make payments. I found a lot of frightening reviews about this Forster & Garbus' tactics. I believe they're like a bounty hunter and have the option of trying to obtain payment & if successful, then they get a cut of what they retrieve.

I went to my city court where the summons was filed and learned it was real. I provided them with a copy of my letter to Forster & garbus, that i had sent certified, requesting them to provide proof of this debt. Other than the return notice that they had received my letter, I have received nothing from them proving i owe the debt. The court took this letter as proof of me responding to the summons.
The court provided me with the statement of the process server- nothing i can do about it but he lied. I found the summons stuck in my door. Other than a child under the age of 18, i live alone in a single family home. The server stated they served the papers to my "co-tenant", as if i live in an apartment or multi-family home. They even gave a description of the woman they gave the papers to- and it sounded a lot like a neighbor, who i've seen but do not converse with and she certainly wouldn't know my name.
In the meantime, i have been paying $20/month to Fingerhut to attempt to pay the debt (total balance was over $900 and i just couldn't pay this amount all at once). I have heard nothing further from Forster & Garbus, so at this point my assumption stated above was true- they're literally just a ruthless debt collector.
Either way, if you receive a summons- respond to it through the court. Do not ignore it. The court informed me that anyone can file a summons and if you ignore it- it's the same as saying you're guilty and they can and will file a judgement against you.
