During 2002 and part of 2003 my 928 was improperly repaired and damages had to be corrected by other automotive shops. Frank's Mercedes Service could not perform the repairs correctly but charged me anyway. They refused to refund my money. I filed a claim with the California Bureau of Automotive Repair and they suggested that I take Frank's to small claims court.

Problems that were caused by Frank's include: Loose timing belt and tensioner, fan shroud cracked and hitting the hood, silent blocks broken or missing, front beading misaligned, paint scratches and impact dents all over the car, glue on the roof of the car, radiator hose clamps fell off while driving causing coolant loss, rear hatch trim broken by techs, transmission cooler hoses reversed, O ring in gas tank installed incorrectly spilling gas on exhaust system, holes torn in drivers seat by techs, carpet covered in grease requiring replacement, Sun roof latch broken, and mis diagnosed radiator replacement.

Additonally my car was left outside with the windows open and key in the ignition. Corrective repairs by other shops exceeded $10,000.00 total.

The people working at Frank's are incompetent and unwilling to correct their mistakes. I never received an apology but I did receive a letter asking me to take my business somewhere else. I called the owner and he was completely unaware of the situation. He never called me back. I am sure that he thinks that I will simply go away. No attempt has been made to right this situation. The service manager told CBAR to give me a message "tell him to take us to court". Great customer service!

Frank's Mercede's got lucky in court. The trial was moved from the original court room to a civil judge who was not at all interested in small claims cases. The judge just wanted to be done with us. I have copies of letters which Frank's FAXed to me that they said they did not send (time and date stamped). They know that they are wrong. It is good that businesses of poor chararcter can be reported to the public. Saving others from making the same mistake is more important. There are other courts where this case can be tried and I intend to do so at my convenience. The public needs to know about businesses like Frank's Mercedes.

In small claims court, we were awarded judgement

In Response to this Claim made by our Customer, his claim was taken to court. In small claims court, we were awarded judgement. The judge deemed there was no case. It is unfortunate that such a forum exists that people who have a gripe or complaint are able to voice it in such a fashion that completely paints the picture that they are in the right and the shop is in the wrong. It is even more upsetting that the truth has to come out this way!
