In September, due to dwindled family finances we contacted Grupo Mayan about either cancelling our contract (and we would give back the "deed" while they keep our paid in equity of just under $20,000 (American $), or to allow us a 12 month period of no payments and tack that twelve months onto the back end of our conract.  Thus far, they have no indicated that they would do either.



In October we personally visited the Grand Mayan in Nuevo Vallarta, and participated in one of their sales presentations (about upgrading to a Bliss or GranBliss).  I explained our financial situation to several company representatives, including two sales managers, who all had "deaf ears".



While we keep getting phone calls about non payment from their accounting office in Texas, no one has gotten back to us to advise us regarding what we can do.



Finally two sales managers said that we should contact the company and ask for our membership to be downgraded from our Grand Mayan membership to a fully-paid (due to our paid equity of just under $20,000) Mayan Palace membership, for our two weeks, in a two-bedroom unit.



I then have contacted their Director of Finance, Felix Aceves, in their Mexico City office, on numerous occasions by Fax asking for this downgrade of membership.



I have also exchanged email with a Ms. Laurie Connors who apparently is with Grupo Vidanta.  Her most recent email of 11/27/09 said that it was not possible for us to downgrade unless we did so while visiting one of their resorts.



I replied, then why didn't their two sales managers at the Grand Mayan in Nuevo Vallarta tell us that ?  We were in Puerto Vallarta, staying at the Mayan Palace in the marina, for two weeks and could easily have done that while there.



I also asked the same question of Felix Aceves; I also asked him (on 11/27/09) to personally respond to me right away regarding this situation and our request for the downgrade.  To date, there has been no reply from either he or Ms. Connors.



After reading some of the other complaints, I believe that what appears to be their "typical stall tactics" are coming into play.  It seems that when I do phone I am told something like "oh that is not in our department, you have to call so and so" !!!  So, I have been dealing with the situation strictly by fax and email.



Maybe there is some attorney out there who would like to involve us in a class action suit against Grupo Mayan ??

Mayan Palace sales tactics are hardcore and they will tell you anything you want to hear to get you into the contract and keep you in contract with them. It is too common for the sales representative to offer you an upgrade if you already own a timeshare with them. Most of the Mayan Palace Timeshare Scam being committed by the Sales representative is that they don’t let their buyers know they have a 5 days cooling period if they wish to cancel; instead, they repeatedly tell they buyers once the contract is being sign there is no cancellation period.

I just visited the Mayan Palace in Cancun and I regretted so much, at first I was happy because I thought I made a good mayan palace timeshare deal but I didn't, actually I was going to bring my friends from Miami next month for them to see the resort and I am very happy that I'm not going to do it. They told me that they can sell 2 of my weeks a year and I call them and is all lies they told me that I have to do that. I just can't believe I spent 7000.00 in nothing. Do not believe them, they do not care and if you ask them for time to finance with ur bank they say they can't and you won't be able to go back in five yrs. u have to do the deal in the same day and *** us we did it but I will make sure that other people won't make the same mistake than us

At this time (February 2010) we wish to remove our complaint, with a reservation.  Our problam has been solved by the management except that we need to sign the new original contract which can only be done at one of their resorts.  (Why they cannot mail us the paperwork is beyond comprehension !)  So, while we have copies of the new contract, we reserve the right to reinstate our complaint should the "original paperwork" not match up with the copies that their management has provided to us.

Therefore, Grupo Mayan, et al, consider our complaint as withdrawn with the reservation to reinstate it should the paperwork not match what has been sent us by email.
