I went to Gustos on my way down to the Keys. I ordered a fish sandwich and when it came out it was disgusting. The piece of fish was small and looked like something you would buy in the supermarket freezer section.

I requested to speak to the manager (who happened to be the owner). I told him my concerns and he started yelling at me saying that I should try paying HIS bills!! He then said that he was going to call the police to make me pay for that nasty sandwich.

I thought that the police would mediate the dispute but I found out after the fact that the owner lets the police eat there for free. When the officer got there he told me that I had to pay for the sandwich.

I told him that I didn't believe him and that I was going to call my lawyer to find out what my options were. The officer physically got between me and the payphone. I told him that he didn't have to be afraid of me leaving, I was leaving my wallet and my boyfriend at the table. I even told him that he could come with me if he wanted to.

He told me that he was "sick of dealing with me", grabbed me and spun me around and handcuffed me. The whole time the owner just stood there laughing.

When the police officer put the cuffs on me my boyfriend said that he would pay for the sandwich. Needless to say, at that point we just paid and left.

So be careful if you go to Gustos. Their food is not very good and you sure as heck can't complain about it!!!

My sister and my wife are both strong willed women. Neither has ever had cops called in to control them, or arrest them. In fact, the only woman I know who has had police escort away from anywhere is my Mother in law. Her BEHAVIOR is the key. As for letting women fight their fights, great. Where I come from, the only females that "fought" were tramps at best. There is a reason men are built the way they are, and women are built the way they are. It is NATURAL for men to defend women, and for men to get the women out of harm's way. I may be a caveman, but any woman with me is safe from anything, anytime. As for getting into law school, good for you. The ONLY requirement is good enough grades, and the tuition. Your behavior at a restaurant is not part of the interview. Your behavior at the restaurant will be a concern if your future employer finds out. Now that you have added the Law School part of your story, I get the feeling that came into play while you were being yourself. I have heard police cadets and law students start spouting legal nonsense before, all to no avail. I have a feeling you started shouting the guy down about your rights and other such nonsense, and thus, the police intervened. They don't just show up and threaten to arrest people for no reason...and a free meal isn't going to get one to risk his job for a false report. Good luck in school. You should consider taking some Psych classes.

I did not even take one bite of the sandwich. The minute the waitress put it on the table I took one look at it and knew that I was not going to eat it. It was about half the size of the piece of bread and looked shriveled and old. It honestly looked like something that had just been defrosted in a microwave. We did have some wings before that and each had a beer. I told the manager that I planned on paying for everything else. Actually, I never even told the manager that I wouldn't pay for the sandwich. I just asked what he could do to rectify the situation. I would have been happy with an exchange for something else of equal or lesser value. As to Robert's comments... I find it quite amusing that you think I'm some kind of maniac who runs around making trouble for people. I am currently in law school and if I acted anything like the way you seem to think I act I would (a) never have been admitted to law school and (b) would never be able to practice law due to the stringent standards of admission to both law school and the Bar. And for your remarks on my boyfriend, I prefer not to justify them with a response however, I feel I must tell you that it is the year 2006 and some enlightened men are secure enough in their masculinity to let the women in their lives fight their own battles. That is obviously not you. In the world of auto parts you make think that men have the upper hand but in the world of educated people that is not the case. Feel free to keep writing your chauvanist comments Robert. You obviously have nothing better to do with your time, I on the other hand do. Thank you to everyone who has written in their support!

Did you eat the sandwich and then ask not to pay for it? Or did you inform the manager after one bite that it was inedible. And request something else. If you infact ate the sandwich then the owner does NOT have to give you the sandwich for free. I know that I would not because I would wonder if it was so bad, then why did you eat it? I'm not calling you a scammer but there are many scammers out there in the world who are just out to get something for nothing. This makes business owners leary about certain things. (Notice the detailed return policies of large corporations) I do agree that calling the cops was taking it too far but if you ate the sandwich and are refusing to pay that could constitute as theft.

Arrested 3 times, found guilty ZERO times. REAL men defend themselves and the people around them Wally. Considering you live on an island that started out as a prison for England's worst retrobates, you come off in all your posts as less than masculine. MOST of my non-commercial customers ARE women. I'll let you in on a secret Wally. When you behave in a civil manner, you'll get whatever you want, from anyone. Heather, like my Mother in law, apparently does not do that, hence the cops were called in. What a coincidence that police have been used on my Mother in law too. They ARE the same. I'll let you in on another secret Wally. Women can pick up on the men who will be men, and those who were just born with the same equipment. When accosted, I can see you now...sitting there like Heather's boyfriend. Guys like me however, would have intervened, gotten Heather out of the picture altogether, and taken care of the issue with the manager. SHE would be safely out of the loop, and I would have taken any of the repercussions...just like a MAN is supposed to do. Since you are too daft to know the difference, taking care of the issue does NOT mean beating on the guy. Again, over here, men deal with men. It's a "guy thing", and women are still not equal in the eyes of most men. They call it the "Good Old Boys Network" for a reason. Some women want a milktoast who they can browbeat into submission. Most do not. You can have the former, I'll take the latter...they're alot more fun to be with.

Well Robert from Jacksonville, Florida certainly dislikes people disagreeing with him and has now taken to denigrating his wifes' mother to try to make us understand that women are stupid and can't do anything without a man. Well, hello Robert, the fairer sex are quite entitled to have an opinion and to stand up to perceived injustice and shock, horror they are quite adept at doing so. I would suggest that you stick to your male customers - you obviously couldn't have any female ones if you are honest with them and tell them that you think they are less than human. You are the most outspoken grease monkey that I have ever come across. I guess if I was trying as hard as you are to climb the social ladder I would be as unhappy as you but I still would never do anything but totally respect all ladies. More power to them and I am sorry that the last one that saw you naked burst out laughing and asked where the rest of "it" was. It has sure soured you! Ignore the mechanic who has been arrested 3 times ladies. Most of we real men have never been arrested.

My Mother in law acts like a coyote when she wakes up in the morning, and stays in "idiot mode" all day long. She has been told not to come back several times in several businesses when I was with her, so it can be assumed she also gets told not to come back when I am not with her. I do know she was demoted at her job of 30+ years for being herself with customers. I threw her out of my house more than once, her son called the sheriff on her after repeatedly telling her to leave, her other daughter and son in law threw her out more than once also. She cannot understand why she gets nowhere with her attitude. She will tell you it is just great, and everyone else has the problem. Is that simple enough for you? Her behavior looks mighty familiar. Her husband is whipped, just like Heather's boyfriend. Why else did he just sit there while Heather acted like she did? No REAL man I know would do so. He should have taken care of the situation and told her to shut the hell up. Of course, he's used to her behaviour. I, on the other hand, have loyal customers, and pick up new ones each week...all through word of mouth advertising. I also have friends and get invited places. I get along with law enforcement types so well that in 3 arrests, I've never been cuffed, jailed, or paid bail. Two times I was even told I could meet them at the station. My attitude is great, thank you. Cops do not go around and threaten to arrest people for a bad sandwich. They do it when you get up in their face after being a total nutjob with the restaurant manager/owner/employees/customers/whoever. Heather can claim she was Tinkerbell all she wants, but her own posting says different. She thinks disturbing the peace and stealing food(not paying for it) is a violation of her rights. Great...go to court and tell that to a Judge. And Wally, I'll papraphrase Carl for you. Did you have something useful to add? If so, you can start any time.

Well done guys! Heather had a legitimate complaint that she was advising consumers of and you macho men saw that she was female and decided to beat your puny chests. I believe she has done everyone a favour by advising of her maltreatment. I am very placid but I would stand up for my rights in that situation also. Well done Heather and hang your heads in shame you MCP's (male chauvinist pigs).

Robert, Do you know the definition of customer service? I would be willling to bet that people have came in to your store and walked out or if they did buy something they did not come back. Heather's experience must have brought back some most recent experiences with customers. As a business owner you should know how valuable every one of your customers are and what you need to do to keep them. The manager/Owner of Gustos should have taken back the sandwich and asked if she would like anythign else. Communication would have been a great option! What does your mother in law have to do with this posting? You know as well as I do no two women are the same Cory, Go work on your own redneck trailer before the Daytona 500 starts. You bring no value to this country and are a waste of fresh air.

"Gustos Bar and Grill had me arrested". "...at that point we paid and left". If you paid and left you weren't arrested. But yes, this could have been handled in a better manner. I suspect you refused to pay and when you did so he called the cops. The officier told you to to pay. Then you told the cop "you didn't believe him and were going to call your attorney to find out your options". I guarantee your attorney would have advised you to pay the man or risk going to jail. Was it worth the couple of dollars?

Exactly what part of my story makes you think that I acted like a savage?

#15Author of original report

Mon, January 16, 2006

I never even raised my voice to anyone involved. Are you familiar with the phrase that "when you assume you make an a*s of u and me." The bottom line is this. I now know through research and speaking with attorneys that a consumer does have rights when it comes to poor quality food. Is it worth suing them now for $8.95? No, but the way that restaurant treated me was abominable and other consumers need to know the possible treatment that they may be subject to. For your information that is the first and only time anything like that has ever happened to me. You obviously have some anger issues that need to be resolved and I would appreciate you not taking out your anger on me. You don't even know me and you were not at Gustos when that happened to me so quit making assumptions!

Who to contact

#16Consumer Suggestion

Mon, January 16, 2006

Apparently "Gustos" has a major problem. You need to contact the District Attorney and the chief of police. It is ILLEGAL for a restaurant to provide FREE food to police officers, and I would contact the DA to bring charges against the police officers for violating your civil rights. When the day comes that you can not complain about bad food without the threat of arrest there is something major wrong! Good Luck. No, I am not an attorney, but have had several cases like yours lately, not the same context, but where my civil rights were violated. You definitely need to follow up on this, for your benefit and for others that may run into the same situation......again good luck!

I own a NAPA AutoCAre Center, not a restaurant. If a customer comes to me acting like a savage, I will return it in kind. When they act like a civil person, I also return it in kind. This is the normal way people behave. My mother in law acts like she was raised by wolves(then thrown out for being too aggressive) when she is in public or private. She gets nowhere fast with anyone, and has been told more than once to leave and not to come back. She's been thrown out of the homes of all 3 of her children, and all of her family members homes too. She thinks she acts just fine. Get it?

I was so incredibly calm and polite when I was dealing with that manager, even when he began yelling at me about the bills he had!!! And as to disturbing the peace, there was nothing diruptional about my behavior. For your information, that police officer violated my civil rights, he had no probable cause for an arrest.
As for behaving like a human, maybe you should try taking your own advice. Are you just a naturally rude and nasty person or are you the owner of a restaurant that serves bad food and this story is just a little to familiar to you Robert?

Are you a total b***h, or is your boyfriend a complete p***y? He just sat there while you "showed your a*s" and did nothing?

In most places, you'd be arrested for disturbing the peace. Try behaving like a human being when you go out in public, and things like this won't happen.

There are ways to approach the manager about a bad meal, buy apparently you don't go that route. I'll make a further assumption that you originally came from New ngland before settling in Florida. You acted exactly like someone from up there.
