I am writing you toady to inform you of the service that I have been receiving from your JdByrider dealership in Jamesville, Wisconsin. I am a 21-year-old female, currently enrolled at West VirginiaWesleyanCollege and I work for the State of West Virginia’s House of Delegates. I purchased as 2006 Ford Fusion from JdByrider (Sales Associate Gorge Doyle)  in May of 2013. The deal was a bi-weekly payment of $182.00 for the next 3 years. I have always made my payments on time and even made payments that were more than the said amount.

Shortly after my purchase (approximately 10 days), I was on Highway 43 in Wisconsin on my way to visit my father in MilwaukeeWisconsin. While on the highway and switching to cruise control, my transmission gave out. I called JdByrider and their response to my issue was to get it towed back to the center and have it serviced. My father managed to get me to his house and we parked the car in his garage while awaiting the tow truck. For several days, the tow truck did not make it to Milwaukee to retrieve my vehicle. There was miscommunication between JdByrider relaying my father’s time schedule to the tow truck. The communication between my father, the general manager (Beth), and me, was of very poor quality. There was even a time she hung the phone up and refused to talk to my father. It was not until the following business day that they were able to get my car and bring it back to the service center in Janesville. I was then issued a loaner car until they “fixed” my transmission. I repeatedly tried making contact with the CNAC bank that financed the vehicle for me and told them that I no longer feel safe in the car and I would like to break my contract and take my business elsewhere. Donnie the CNAC accountant at the time told me that was not possible. (This was all within the 30-day limit of the purchase of the car.)

After finally getting my vehicle back, I went back to school in West Virginia, which is a 700-mile drive. I came home during Thanksgiving break in the midst of November and I reported to the JdByrider service that my brakes were not working well. Jonathan the head service provider told me that he would, “test drive it and put it in the air and take a look at it.” A few hours later, I was told to pick up my vehicle because it was finished. Once I got into my car and began to drive back home, nothing was fixed. I called back to the service desk and Jonathan insisted that they had checked everything.

It was now December and time for Christmas break and I was headed home. On December 9, 2013, I was in Morgantown, West Virginia. I was driving South on Monongalia Drive and another vehicle had merged in front of me. I was headed down hill and I applied the breaks as I was speeding up and my steering wheel began to shake. Unfortunately, I was not able to stop and collided with the vehicle ahead of me. No one was hurt, but my car was totaled. Through my insurance, I was able to get a rental car and make it home safely.

I contacted JdByrider and began to settle my dispute in hopes of getting another car as soon as possible. The day that I contacted CNAC, I spoke with my original account holder Donnie and he agreed to working with my insurance and getting me a reliable car. The very next day I called in to check the status of where we stood and Donnie no loner was employed with CNAC. I felt uneasy and unsure beforehand and that made it even worse. I then proceeded to carry out the plans with Kristen who was in his position. I was told that my 2006 Ford Fusion would be replaced with a 2003 Dodge Stratus and my payments would remain at 182.00 and nothing would change with my loan. I was highly upset that I was paying that much for an older car.

To add insult to injury, I was told that they would not give me temporary plates. I called the DMV in Madison, Wisconsin and was told that by law, the dealership had to issue me temporary plates. I was made to beg the general manager to give me temporary plates just so I could get to West Virginia and retrieve my old plates from the car garage that housed my vehicle before I released it. The general manager insisted that she could not help me, but then followed up with her claim and said she would add the 185.00 plate charge to my payments to pay it all off. I was in no position to argue or dispute due to the urgency of my arrival back to West Virginia. I am now in West Virginia with a 2003 Dodge Stratus with 115,347 miles on it. I had considered the option of trading in the car and going with a dealership here in West Virginia. I was told by another facility that JdByrider definitely took advantage of me and exploited my finances. I am fed up with the service that I am receiving from them as a faithfully paying customer. I would like for one of two things to be considered as a resolution to my problems. The car that I have now in my possession to be upgraded to a vehicle of equal or greater value as my 2006 Ford Fusion or that the contract between CNAC be voided upon the return of the 2003 Dodge Stratus and the remainder of the loan be forgiven.
