I won ebay auction 160216630711 on march 10th 2008. Check sent to seller jonnyjz06 who cashed check on March 19th 2008 in the amount of $159.33 (citibank check 1060). On march 24th I emailed the seller jonnyjz06 asking why I have not yet received parcel. I was told "Personal checks hold 10 business days then ship, Your Item will ship April 1st".

As of aprill 11th i still have not received item. Further e-mailing and calling the seller have resulted in nothing. He refuses to answer question regarding my purchase. attempts at retaining a refund have also failed. Communicated with seller through ebay dispute console which allows ebay to see he was being un cooperative. As of april 12th 2008, I have closed dispute and escalated to ebay fraud department who in turn recommended I post at this web site. Here is a small piece of info Ive discovered on this person.

Let me also post here the info on you that Ebay emailed me. Funny how if your being falsly accused, ebay seemed to be willing to send me your information as well as terminate your account with them! lol idiot This message is an automated reply to a contact information request made by creo72. Your a liar and a thief. You plain and simply took a check AND CASHED IT which I do have a record from my bank showing even though EBAY doesnt allow auctions to be viewed from back then.

The item was for a batman museum statue should i need to jog your memory. Or maybe all the emails I have from you basically saying your not going to send me my item which you sent through ebay will make you remember.

oh and for the record numbnuts, ebay most definitley allows sellers to be paid by check, nice try!

Hello Sorry but i have no idea who you are and why you posted this outlandous statement. Now if your looking to post bad comments you have been successful but MAYBE PEOPLE WHO READ THIS KNOW THAT EBAY DONT ACCEPT ANYTHING BUT PAYPAL. $160 SALE WAS FOR WHAT.....???? You know no one can look up a idem on ebay once 30 days have passed. I would nbever in my life take a check from anyone... Sure this is some kind of slam !!!! Maybe you never paid on bay or unhappy with you purchase with no refund or?? Sorry not a theif ! Anyone can post on here with no legal recourse for slander... Has anyone SEEN A AUCTION? A PAYMENT WITH MY SIGNATURE? All You need is a email address and some crap statement to post here. If i DID WHAT WAS STATED ,,,,,......PROSECUTE! I STOLE NOTHING !!!!!! Ebay offer buyer protection ??? I can not even see what that item is on ebay to retailiate ?? jon No !!!

Keeping in mind that I won the Auction in March. The tracking # the seller listed on the negative feedback he gave me states " Label/Receipt Number: 0305 2200 0000 8636 5585 Status: Delivered Your item was delivered at 9:52 AM on February 23, 2008 in CHARLTON, MA 01507. "... How did he deliver a package to me (February) 2 weeks before I even won the auction? He is a mind reader who knew I would win the auction 2 weeks later? lol... Are you serious!!!

Karen, Thanks for the advice, However there are a few things you have mistaken, or I did not list. 1st, right after the auction I was told by the seller (jonnyjz06) that the "item was in stock and ready to ship". I have e-mails from the seller to verify this! 2nd, I actually sent out the check may 1oth, it was received by the seller im assuming in a couple days. The check was cashed, cleared my bank on March 19th! I waited untill April 9h to ask the seller (jonnyjz06), for the details on my package IE: shipping estimation, tracking info, anything pertaining to it. My emails were ignored for 2 days. I then Called the seller by requesting his onfo from ebay. He did not answer nor did he return my calls. I gave him a second call to state that I had opened a dispute on Ebay that he needs to respond to. Suddenly he was responding on the dispute, but not about my package! he simply asked why my phone number on ebay was different from the one I called from or supplied to him prior. My answer was that it is a number to my relatives office (happens to also be a law office). I cant be reached there directly however the call will get to me. On this, the the seller (jonnyjz06), filed a report to ebay on me having listed incorrect information, address, phone, bank account etc!! This was his way of justifying keeping my money and not shipping me or completing the auction (because my Telephone number isnt direct to me gives someone the right to steal?)..For the record, all my other information is 1000% correct!!! PLUS I had sent him a "check is on the way notification through EBAY" that lists my shipping information!! SO theres no way my package should be in another state OR that he would not supply the tracking info to myself or EBAY days earler! Ebay has sent me some fraud links that I have listed the seller (jonnyjz06) on. Im currently opening a case with the USPS for mail fraud, and visiting my local authorities! I have noticed that in the past couple days, there are others posting against him on ebay for non received merchandise! I thought paying by check was secure in the sense that I can prove it was cashed from my acocunt and into the ACCOUNT OF SAID PERSON!! I mean who would be so stupid to cash a check into an account that could be tracked? In personal e-mail ie receinved from him, he basically laughs at me and ignores all questions on refunds or the package!

This post is more for those reading it, since the complainant's eBay history shows that he is no stranger to eBay buying/selling or neg feedback. Never, ever, ever never buy anything online with a check or money order. Not EVER! You have absolutely ZERO recourse if you pay using either of these methods. Sure, you could file with the post office for mail fraud. Wait the 6-8 months and see what happens. You could even get the kicked off eBay. But the odds of getting your money back via those avenues are slim to none. Your bank will probably not help you if you pay thru bank transfer, so PayPal bank transfer is not a good idea, either. Plus, once they take the money out of the PayPal account, it is lost to you. If you must purchase online, use a credit card. If a seller will not take a credit card, then you don't need to item badly enough to take a chance on losing your money. Having said that, let's take a look at this auction and the seller you are accusing of fraud.... First of all, I don't know why anyone would trust a seller with a 95% feedback rating. Always check the feedback first and don't waste your time with less than 99.5% UNLESS they are selling specialized items or tricky terms of sale (like taking checks and waiting for them to clear before shipping at a slow method, in which case the buyer agrees and should not complain) . Always read what the neg feedbacks are for. The number of feedbacks is just as important as the reason for the negs. Go to www toolhaus org to read the sellers negs and decide if it is worth the risk. In the case of your auction, you were high bidder on March 10th and sent a check on March 19th, a full nine days after auction. Allow 5 business day for your check to arrive in Buffalo NY, which would put you around the 22/23th March, a weekend. If the seller deposited the check on the 25th, the 10 BUSINESS DAY clearing process would have rolled around on or about March 8th. His auction claims UPS ground which is another 2-6 BUSINESS DAY delivery. All this means that you have might not been scammed at all. Buyers should ALWAYS be careful to read the entire auction terms of sale, payment and shipping so misunderstandings don't happen. Your seller seems to be claiming that he shipped to you, providing a tracking number and getting the package back for wrong address. Either he provided you with the wrong tracking # or your batman is in Charlton, MA. And he used USPS, not UPS as stated in auction. Good Luck and sorry this happened to you. I hope you get your Batman or your money back.
