I've got more bad news for you, most places sell soda this way. If you're bothered by it, just wait until the ice melts......problem solved, cup full.
You aren't the first dope to complain about petty things like this.
You took a measuring cup with you? I'll bet they're still rolling on the floor laughing at the KFC.

That's weird. Not a fan of KFC. I wonder if it's like that in all stores?
Back years ago when I worked for McD's the cups were actually larger than the drink sizes specifically to hold the ice. The soda was dispensed by a calibrated machine to the once. Our biggest problem was with customers who ordered "no ice" and were upset when the cup wasn't filled. Hearing that the extra space was for the ice they did not want and that they were getting exactly the advertised amount of soda for the listed price sledom molified them.
If they don't do refills or you are doing take-out/DT you could order it with no ice and make sure they fill it to where you measured the 16oz level to be. Soda comes out of the machine cold so you don't really need the ice (or maybe ask for the ice on the side in a courtesy cup)??

Most restaurants give you free refills anyway, so make sure you get yours.
Or
Just tell them you don't want the ice filler
or if they don't wanna play fair,
just make sure the cup drops on the floor when they try to hand it to you. Not only will you get another drink, but they will have to mop up.
