I purchased a car from their car dealer Ocean Express Auto. I was lied to about putting a co-buyer on my contract that I knew nothing about until I ended up in jail by the co-buyer who falsely arrested me and took my car. The co-buyer went as far as to falsely put a restraining order on me then moved all the way to Arizona with my  car.

There is  no way they shouldn't been able to do anything about this. I didn't even enjoy my car for a good six months. There was no reason for the co-buyer to take it other than she wanted my truck. This is something that needs to be paid attention to. If I have proof I put the 5000.00 down on the truck they should have been able to help me get my truck back.

Simple issue with your co-borrower...

Jim is exactly right on this issue.

According to your post, you signed a purchase agreement with the dealership and had financing with Lobal (or a third party finance company) that required a co-buyer or co-borrower; neither the dealership nor the finance company have anything to do with the actions of you or your co-buyer after the vehicle purchase. The only time the finance co would be involved is if you or the co-borrower defaulted on the payments due or defaulted on any other term in the contract you signed with the finance company. The finance company doesn't keep track of who has possession of the vehicle, except in the case of default.

You have a beef with your co-buyer. If you can't work out something satisfactory with the co-buyer directly, then take her/him to small claims court. However, unless you have a separate written agreement for usage or other terms directly with the co-buyer, you may not have any recourse there either.

Did You Read The Contract?

If there was a co-buyer, then that person's name would be on the contract! Did you read the contract? If there is a co-buyer, then that person has just as much legal rights to the car as do you. The only way this could be theft is if you are the sole owner. If this is a relationship gone bad situation or if that person was simply using you then Lobel has zero responsibility in the matter. If Lobel said you needed a co-buyer due to your credit, its STILL none of Lobel's business! If you guys are co-owners/buyers then this is a civil matter not criminal. Lobel simply supplied financing on behalf of the entities on the contract. My next questions are who lied to you? The dealership? How do you know it was a lie? You said the co-buyer "arrested me". How could that happen? Was the co-buyer a police officer? The matter of the restraining order...did you state your case at the hearing? Again, this appears to be a civil matter and is between you and that other person with Lobel not an involved party.
