3/30/2017 Referred to Attorney Marc Ominsky by Legal Zoom for a FREE consultation, verified as FREE consultation by both parties.

4/03/2017 Paid Law

Offices of Marc A. Ominsky, LLC $884.00 partial payment to be used as an installment for services to

be provided. This was not for the initial FREE consolidation which consisted of watching a 15-minute video in a conference room by myself.

Marc came in and added a few words clinch the sale no more than 3-5 minutes and left me with his office staff to pay.

I had concerns about paying for services IN FULL UP-FRONT and no service provided or filed, they were not friendly

about my concerns, and I felt pressured and uncomfortable and paid half with the assurance I could

recover my deposit in FULL. I was verbally assured by Marc assistant who is not an attorney, I can get my

refund back in full if I didn’t want to continue and Marc was an upstanding professional attorney in good standing with the Bar.

Desired Settlement: FULL Refund

Desired Outcome Description:

6/27/2018 The billing is as follows: 1.0 Marc

@$400/hr = $400.00, 1.1 Ashlie @$175/hr =

$192.50 Total = $592.50 Paid $$884 To Refund.

$341.50. I would like a FULL refund of 884.00 As of

10/19/2018 Law offices of Marc A. Ominsky, LLC has not refunded my initial installment since receiving a

FREE consultation. I am disputing Marc bill as follows

1 hour at 400.00 and 1.1 hours of secretary billable

time at 175/hr. 592.00 in FABRICATING FEES! Charging for work he never did 1 hour for me watching a free consulitation video?

4/12/2019 From Marc Ominsky email

“Mr. Pierre:

As I stated in my last e-mail, the rip off report still remains online.  You take care of that and I will not move forward.  I am certainly not aware of where you got the “video’ from, but it wasn’t from me.  I can have many former and present clients testify that I do not use such “video” in my practice.  However, I do not want to deal with the matter any longer and I will send you the $344, once you take care of the rip-off report and agree to let the matter rest. --Marc Ominsky “

As stated in my previous reports I paid $884 which was partial, nothing was done no service received all lies. I was willing to receive the above from Marc and move on with a partial loss however his intentions is to keep the remaining of my money and threaten and bully me, he is not even honest enough to return the balance of my money this is his true nature.

The balance owed has nothing to do with rip-off you have taken 543.00 for a FREE consultation, and refuse to send the remaining of my money $344. Now being used as ransom, not even Donald Trump is this bad! I will continue to pursue this since Mr. Ominsky and company refuse to be dishonest and NOT do the right thing.

Thank God for rip-off an outlet that offers true consumer platform, hopefully, others can read my story and avoid this firm. I am down and out and this firm feels entitled to treat me without any respect, compassion or professionalism. you deducted 543.00 from what I paid you for work you claimed you did, what’s your excuse Marc for not giving me the rest of my money back $344.?

it’s not rightfully, lawfully, or legally yours to hold as ransom.  I was willing to post on rip-off that we came to an agreement but in light of everything you need to give me my remaining money and lets part ways. I will not ask rip-off to remove this BTW they don’t remove anything, my statements are factful and true… If I was lying as you are stating why worry about my post?

You are will to pay me with my own money to remove it, truth is you're a very corrupt person and I’m not stupid to settle for what is mine your terroristic and ransom threats will not work…

Marc you’re a LIAR! Plain and simple. 1st and foremost I didn’t get an hour of your time. I watched a 25-minute VIDEO and I agree with your reply. You admit “It’s is a free consultation”, you have held on to my money for close to a year, dodging calls and your staff acted very hostile. You’re a dishonest attorney to even lie about the video “really, seriously?” I’ve filed a report with the Better Business Bureau as well filed a complaint against you with the ATTORNEY GRIEVANCE COMMISSION OF MARYLAND it’s all on its way. I’ve worked for the federal government for years and hold a public trust clearance that speaks to my character ---SIR.

By the way Marc’s firm site only has 8 positive reviews probably family members or friend … mdlegalfirm.com/

False and Inaccurate Report

#5REBUTTAL Owner of company

Each prospective client who meets with me and retains me gets at least one hour of my time.  If a prospective client is not interested, then they do not sign a retainer nor do they pay any money.  It is a free consultation, if they do not want to move forward.  Otherwise, I will not spend the time.  If they retain my firm, then they get a retainer and a packet that I have worked to build for years.  They then meet with my staff to go over the packet.  The meeting with my staff is usually for at least 1 hour, unless a person needs more time.  The retainer reflects what our hourly billing is if someone decides to not move forward -- AFTER WE SPENT OUR TIME ON THE CASE.

"If my case is not filed with the bankruptcy court for any reason, the money that I/We have already paid to the Firm will be used to pay legal fees rendered to date on an hourly basis, this shall include “all time” including the initial consultation (in the event that the Firm is retained you will receive a packet and the time spent on the initial meeting will be included in any fee), packet review(s), attorney review, processing, etc."

I DO NOT KNOW WHERE THIS CHARACTER CAME UP WITH A STORY THAT HE WATCHED SOME "VIDEO."  Though I wish we were more technically savvy, I do not condone using a video.  The only video I am aware of (if you can call it a video) is the requirement that he take credit counseling online.  However, we do not have anything to do with the businesses that conduct the counseling.

I have met with hundreds of people over the years.  I have never used a video.  This person is angry that he couldnt' get a full refund after he wasted our time.

I have represented many people over the years in numerous legal areas including bankruptcy, family law, car accidents, drinking/driving, business litigation and civil litigation.  Bankruptcy is a favorite area of practice for me, as it allows me to free my clients and their families from countless overbearing debt.  It allows them the fresh start they deserve.   However, sometimes we run into people who do not treasure the time we spend to assist them.  This guy is certainly one of them!
