On February 22, 2010 I had signed a contact and made a down payment for a 2004 Cadillac CTS. The down payment required was $2500.00. The $2500.00 was to get the paperwork rolling for a loan. DR of Cadillac explained the Drive Financial would give a call to interview me. After the interview the dealership would be funded and delivery of the car would take place. Drive Financial contacted my employer and verified employment and salary. On Tuesday March 2nd Drive Financial called and asked a series of questions. I felt confident at that point that ball had began to roll. I called DR with excitement. She said that I may be able to come Wednesday March 3rd to pick up the car because they would be funded by then. I did not receive a call on Wednesday March 3rd. I called and left various message on D. and A.Z's (office manager) voicemail. I did not receive a returned message on Thursday March 4th. Finally after a few attempts I was able to get a hold of A. on Friday March 5th @ 12pm. I asked what was the holdup. He said let me make a call to the bank and I will call you back. He never called.
I decided to call Drive Financial. As it turns out the customer service representative stated that I was approved for the loan but the application was returned to the dealership.
She could not disclose any information other than I had to reach the dealership.
On March 5th @ 2:30 pm I called A. and he said that they were having problems with the bank.
Monday March 8th I called Anthony 11:30 and asked him if he had any news. He said Liz I have no answer for you. At that point I requested my down payment. A. said that checks where cut on Friday and that I should be able to have it then.
Friday March 12Th @ 5:25pm A. said the check was not ready because the signer was at another location at a meeting and he didnt think he would make it back at all.
Monday March 15th. I made many attempts to reach A. was transferred to various voicemails (J.M & G).
Tuesday March 16th. A, stated the owner's mother had pass and was not in the office to sign check.
On this day I filed a complaint with better business bureau Complaint case # *******
Thursday March 18th. Left several voicemails.
Filing lawsuit in Small Claims court for the sum of $2500 plus incidentals
Filing complaint with Attorney General
I am requesting my down payment of $2500 because there is no delivery of car.
I am no longer interested in doing business with this dealership.

Thanks the Greater NY Automobile Dealers Association, my money was refunded on March 27th.

I am staying positive that is suitation will be resolved soon.
The Greater NY Automobile Dealer Association received my complaint and got right on it in less the 24 hour.
The dealearship claimed that they had no record of my payment.
I was able to fax and email over a copy.
Hopefully I will not take long.
I will keep updating.
