My daughter receive a notice from NCO Financial Systems stating that she owe them money for a computer she purcahsed in 2000 from Gateway.

She called to tell them this was not her bill and that she had never purchased a computer from anyone. At this time they put a Mr. Joiner on the phone and he told her that lying would not make her debt go away. She got very upset and told them that she was not lying. The thing that worried her was that they had her SS # and PO Box that they mailed the notice to. She has only had the PO box for 2 years (her mail was not forwared either).

They told her in the statement they were will to take 50% of balanced owed. She told them she was not giving them 50% of something she did not owe. Then he told her he would take 500.00 instead. She told them that she did not have 500.00 to give and she did not owe the debt. He started asking questions about where she banked at. That is when she told him she would contact a lawyer. He said "You have the money to contact a lawyer but not the money to pay your debts". This is when she hung up on him.

Three days later she received another statement from them saying once again she owed them. We are sending a certified letter letting them know this is harrasment and this is not her debt.

Make, a complaint with every agencie the Better Business Bureau, PA attorney general office & the federal trade commission I did these 3 things & nco back down & never contacted me again. Also, my only income is social security disability I had an credit card 5 years ago I was not able to pay anymore they started harassing me if u are on social security disabillty nco or any other collection agencie cannot touch it or garnish u are protected from that. I, have read this from past advice on nco complaints its my only income I also put this in my complaint & nco backed down & stopped harassing me for a bill I could not pay. After, that one credit card I made sure I didn't get anymore credit cards that I couldn't pay for I did not want to be like everybody else in credit card dept, so my credit is clean & I hope I will never have to file bankruptcy in my lifetime. I, am keeping my credit clean while I am young so I can have a good future. I, learned from other peoples mistakes. Don't create dept.

NCO is a collection agency and under the FDCPA(Fair Debt Collection Practices Act) they must follow specific rules. You don't need others to do what you can do yourself. The thing you need to do is send them a certified letter with return receipt requesting validation of the debt. This will prove when you sent it and that they did in fact get the letter. In the letter state that this is not your debt and you require proof that they are authorized to collect the debt. Also, you need the original agreement that proves you in fact did sign up for it, as well as a complete payment history. Also state that they are not to contact you by phone again. They have 30 days to respond to you. If they do not respond in 30 days you can write the Credit Reporting Agencies and have this item removed. Now here is where the fun comes in. If they contact you again by phone after they receive it you can sue them for $1000/violation per the FDCPA. If they do not validate after the 30 days and continue to attempt collections you can again sue them for $1000 every time they do this. All you need to do is file a small claims case to avoid having to hire a lawyer.

I had the same problem. NCO mobsters trying to collect on a debt that was not mind. What I did. I filed a complaint with the Attorney General's office of Pennsylvania. This is the Website www.attorneygeneral.gov. In 2006, They were sued by the A.G's office. They settled Apparently they have not learned their lesson. I say suffer NCO Mobsters. I also filed a complaint with the Federal Trade Commission. This their website. FTC.gov. The odds are they will back down. They are probably chasing the wrong person. Go to Budhibbs.com. You can tell your story there. NACA lawyers are great. I have one suing a mobster outfit for trying to collect on fraudulent debt. Bud hibbs has a link to NACA lawyers. Nevertheless, Fight these bozo's and do not talk with them on the phone. Do everything in writing. Tape their conversations if you must. For 20.00 radio shack has a device to record. Get them threatening and get yourself a big chunk of money. Best of luck nathan
