Nature of complaint: A failure to honor a contract or agreement

Problem description: My husband and I purchased/ordered a Modular home from Oakwood Homes and signed a contract in January 11. 2014. Our sales lady and person of contact was Lorie Hollen. The price of the home was to be 150,000.00. Since we were paying cash for this home we were told we needed at lease 1/2 down for them to get started, so we gave them a cashiers check for 80,000.00. We were never told that we would be required to give balance before home was completed but we found out that when we were called in on April 14, 2014. At which time we were told they needed the balance of 75,000.00, now. It was 5,000.00, over our agreed contract cost and was told it was due to additional costs. ??? no explanation given for what these cost were to be ever. Our sales lady Lorie Hollen then took a leave of absence due to health issues and the only contact we had was the manager Gil Fleming who was totally clueless to our home and what details were involved. We were called in to the office on April 14th, 2014 and was told by Gill that we had to pay the balance now, before home was completed since we were paying cash we were told. Home had been put on property that day and they wanted/needed the balance paid at that point. Were was my warrentee that they were even going to finish my home?? We were told that our home was going to be completed by Easter. It was not, then every week it was to be completed but again to this day which is May 16, 2014 it is not. We have been storing our furniture in a unit which cost us 89.00 per month, and since it was way past the point of us getting into our home Oakwood Homes, Gil Fleming (Mgr) said he would pay for the Month of May's storage. As of this day he has not.

On May 15, 2014, we got a warning from the storage until manager that it has to be paid or we will not get our belongings out. After our paying of the balance on our home we were told by Gil Fleming on 5/3/2014 that that weekend the trim would be done on our home and we could move in by end of the following week, it did not happen, again on 5/9/2014 we were told that trim would be done by end of weekend, and again it did not happen. Then we were told by Gil that when the electric was connected it would only take 1 day to finish our home. The electric was turned on 5/13/2014, as of this date 5/16/2014, home is still not done. My son received a call today 5/16/2014, from Gill Fleming telling him to tell us that home will again not be completed until end of May. No explanation. When we went over to our home on 5/14/2014 we noticed that one side of the home the electric was not working. I called and spoke with Gill Fleming and he said to me call the electric co. I told him I did but they said that the problem was in our home wiring so he sent out one of his electricians and they found out that the electric was not connected and wired correctly on that side of the home.

We paid 155,000.00 cash for this home and was promised that we would be in it in 3 months. It has been well over that and still we are not in our home. They put the incorrect flooring in our home, wrong color in carpet and hardwood. They were to paint the home but it is two different tones, the trim is still not completed. This has taken such a toll on my family and especially me. Found our sewer still needs to be completed and water still not connected. Lots of promises lots of lies. We paid for 5 back windows, only got 4. We made color choices but they were changed. We paid for stone color on fireplace and it was sent incorrect. We also had paint thrown on our back side of our home and porch. Lots of paint drops on flooring and paint job was horrible. scratches on flooring also and on new sink.

 Of course Oakwood Homes, Gill, you are going to say this, but you and many others know better. I would invite anyone to come to our home and see the different colors of paint on our walls and ceilings. The crown molding on the ceiling still has several cracks, looks awful, but still no one has came to put caulking around them. Kitchen sink needs replaced, scratches from your contractors, side door needs to be turned. Its on backwards, can't get out of the door let alone get in it without alot of hassel. Flooring still needs fixed in spots where your men scratched it up, this and alot of other things (on punch list) still needs repaired, where are you. Why do we have to come to the office to ask when this is going to be finished. As far as the little roof over the side door PLEASE do you think that this is your solution to not having to make the corrections in our home. This was just a bandaide for your neglience. Was told "your home is the first to go thru the new factory built in pa. it will be perfect" I also have pictures of colors of the carpet and hardwood flooring that was faxed from your office to Redmond Homes as far as our color choices in the beginning as to the carpet, hardood flooring, fireplace stone choice, and of course that front door without the window that was supposed to be put on top of door frame. You also forgot to mention the paint that your subcontractors did to finish painting the home was discussting. The paint had been splattered over our flooring inside and outside of our home on our siding and porches. Lets also explain to our readers that you tried to charge us for porches and 2 weeks later said "oh I see they were included in the contract". then you put a small porch on back 4x4 with 8 steps to go down to ground. fitting only 1/2 of the sliding glass door frame and then the contractor you picked out put low grade wood building the steps and it started to come apart 3 weeks after he finished it, thats what you get for hiring cheap labor. It took me over 4 weeks to get that repaired....thank goodness no one fell from the steps. As far as the punch list it still is not completed and that has been over 3 months.... Remember Gill, pictures speak better than words. and so does neighbors and family and friends who watched you ignore our constant requests to get the home we ordered. We paid alot of money for our home, and at signing of contract we had to come up with 5,000.00 more... for WHAT? No more excuses. No more passing the buck blaming it on Redmond homes, the builder. You or at least the sales agent who first took our contract with all the details need to come clean and admit you messed this one up badly... Again, I warn all not to purchase a home from these people. Get everything in writing and take lots of pictures and make sure you get copies of everything. And last but least if your sales person quits, beware........

Mrs. Ames recieved a beautiful home at an excellent price they saved over $49,000.00 on the project. We did all we could to move things as quickly as possible the weather did not cooperate but we worked as quickly as we could. Mrs. Ames expected someone to be at the home or property every single day, that was not necessary or feasible. I understand her frustration, they sold their home and are living with family all the stuff is in storage. I spoke to her last week and explained that we would be done by Wednesday of this week with final inspections and requirements. Everything was completed Tuesday of this week 5/20/2014 The electric was just activated on 5/13/2014 we have been waiting a month for electric. Once the electric was activated I arranged for all contractors to complete the project, things that we could not complete before because of no electric such as plumbing inspections, electrical inspection, AC install and check, Final County inspection, we couldn't put in the driveway till the electric was trenched because they were trenching through that area. The home is in a flood zone so we have to have that final review completed with elevaton certificate we needed to wait for that AC to be placed before we ordered that. we completed all this work and the driveway, walkways grading in less than 2 weeks after electric activation. I do not see that as being negligent. Mrs. Ames was always aware that she needed to bring in the balance of the money before the home was to be setup. that was established before the home was ordered.

Mrs. Ames walked the home with me before it went to her site and approved it as it was she never mentioned any color issues at that time. Mrs. Ames called me 2 weeks after we set the home and stated that the floors were wrong and the fireplace she mentioned a window over the front door that was not on the order or paid for Mrs. Ames and I met and agreed that we would build a small awning over her side door to compensate. Mrs. Ames complaned that she had to pay more storage fees due to delays I told her I would pay the May fees and have paid them. There were many changes back and fourth on the home order The customer added many things as we went on with the process before the home was ordered, and yes the sales person did go out on leave but I met with Mrs. Ames several times to go over the order, It took a long time to have the home engineered, built and delivered I kept Mrs. Ames informed through the whole process.

The home is beautiful we did our job followed all policies, plans and procedures this is simply a situation where a customer is stressed out and staying with family her life is in turmoil and she is lashing out. It pains me to see customers go this way, they received a beautiful home at on very excellent price and in my opinion it was in record time as far as time frame to completion, we set the home on the lot in April the only delay was the electric company cause they are so backed up after this grueling winter. My hope is that the customers realize that the anger and bitterness that is in this complaint is misguided and not the way to get things done, we never lied to them and they certainly were not cheated.

 Mrs. Ames was provided an absolutley beautiful home at an absolutley awesome price! the retail price for the home alone was $151,300.00 then the improvements of septic, well, block, plumbing, electric, steps and deck, driveway, gutters set up and finish work, the project actual retail price should have been $199,300.00 we sold the home and improvements to them for $155,000.00 after discounts and incentives! The customer saved $48,000.00! Since it was a cash deal we needed to have the balance paid in full once the home arrived and the customer viewed it and before it was set up. I personally walked the home with the customer before it went out to be set up she loved it and was very pleased, then two weeks later she called me and stated that the colors on the floor and fireplace were not correct. We met and made an agreement to do a side awning over her side steps at no charge.There were no surprises regarding the payment agreements it was very clear way back when the sales person was involved, There was some confusion regarding colors options etc due to the sales person leaving in the middle of the deal but I did my best to make sure we met all reasonable deadlines and I worked with the customer to resolve all issues regarding the order of the home. There were delays in getting the home here due to factory restraints and engineering there was nothing I could do about that.We just set the home the middle of April. The electric was just activated on 5/13/2014 when she informed me that the electric crew was on site I scheduled everyone to get the project done. There are certain things that could not or should not have been done until the electric was on, we couldn't do the plumbing and inspections, we could not get finals from the County, we could not do the driveway due to the fact that the electric company was going to trench right across it, Mrs. Ames expected us to make everything happen right away but our contractors can not just drop everything they have going and run out to this project leaving other customers hanging..The home is complete as of 5/20/2014 we are just waiting on the County to issue a CO. I informed Mrs. Ames of our schedule she is at the property every day and expects us to be there every day which is simply not feasible. The home is a show piece house it looks great inside and out. Mr. and Mrs. Ames are staying with family and have their furniture etc in storage I agreed to pay for May storage and I have done so. It pains me to see this kind of overreaction from a customer I feel this project in no way deserves this kind of deframation.There is no perfect project, there is no perfect timeline in construction especially with the weather we have endured this year. The electric company is backed up due to the winter we have had and our contractors are backed up due to the same. I feel we have done a good job and been reasonable with our pricing, proceedures and agreements, my hope is that our customer will look at this from a different prospective and try not to be so bitter and angry over things that can not be changed or controlled.
