My wife and I were in the market for a new Elliptical fitness trainer. We stopped into the Ledgewood, NJ Omni Fitness store on August 31st, 2008 and purchased a Precor 5.35. They told us it would be a couple of weeks as they were backordered. That was fine.
Fast forward to today (November 10th, 2008) and still don't have our elliptical. As we discovered, they filed for Chapter 11 a few weeks ago. I am assuming they knew about this and still sold equipment they would never be getting. They are still open and selling equipment. I feel sorry for others that will get caught in their lies.
I have contacted them several times, even spoke to the district manager today, and they basically said to me that I could take a floor model or nothing, but would not be cancelling the order. They wouldn't even discount the floor model which we don't even want as we ordered a brand new machine and were charged for one a new one.
So I am currently stuck being billed for a machine that I will not get at all. My only recourse is to contact a lawyer and file a credit request with the courts where they filed Chapter 11. I should not have to pay or go through the hassle of using a lawyer for something we did in good faith, which was purchase a product.
At this point we just want the order cancelled. Would love it if someone can help in this matter. We feel cheated, lied to and completely ripped off.
