12/31/09 Recently PharmaLabs, LLC advertised on the Internet a free trial offer of the ACAI vitamin product for $4.95 handling charge only!  No other terms, periods, costs, etc.  Celebrities were in the advertisement and it was associated with another vitamin by Colnx - a colon cleanser product you take with the ACAI to help loose weight.  You take both, but, order both from their respective companies PharmaLabs and then the company, Colnx. 

No where in the ad did it say how much the vitamin product costs if you want to order it and no where in the ad did it say I had to cancel within a certain # of days, otherwise, I would be charged $79.95 and then 2 weeks later $84.90 per bottle and a 2nd bottle is sent out.

After receiving the Trial bottle, about 2 weeks later another bottle arrived in the mail, which I did not order - no receipt, company information, instructions or terms were mailed with the bottle, which is strange.  I thought it was a mistake, they sent 2 bottles. 

Last Saturday, when checking my account, at the bank, I discovered PharmaLabs had charged my account $79.95 on 11/25/09 listed as PHARMALABS LLC on my statement and then on 12/11/09, $84.90 with the same name.

They are outright stealing money from my account which I did not authorize or order any item or product for this money.  I presume they are hoping consumers do not check their accounts and realize what is happening.

I called to yell out the customer service staff and demand my money back for something I did not order or authorize.  Their customer service rep Maria said I need to send the product back at my expense, which I have done this past week, Certified Mail, with signature receipt requested and then they will give me a full refund in 5-7 days.  I have to wait and see if they refund the full amounts taken from my account at this time.  Meantime I am out this money from my account and have had to cancel my account.

PharmaLabs, LLC and Colnx are using this same way of stealing money from my account.  And, the price is outrageous for a small bottle of vitamins.  Vitamins at Whole Foods Store may run on average $6-15 a bottle, depending on the type of Vitamin, so you see there is no comparison.

Hopefully my bank will help if I do not receive all this money back and I am interested in helping any attorney who can fight this fraud for innocent consumers.  It's disgusting how they can steal money from my account and think it's okay.

PharmaLabs would like to clarify that the Terms, Periods and Costs are stated clearly on the website where the credit card information is entered. You can visit our website at www.pharmalabsacai.com and on page two where the credit card information is entered, the terms are clearly stated. 

I have not been able to pull up Heather's information because we don't have enough information, but feel confident that if she was promised a refund, then the refund should have been processed.  We are a legitimate company and stand behind our product as well as if we promise a refund, a refund will be given.  Same with trial cancellations, we have a no hassle process where we will cancel your account and no additional charges will be made.  Thank you.

This type of scam has been around for a while in a variety of industries. The quick way to flush it out is try to order the item without a credit card. Any legitimate business with a legitimate sales offer will be glad to take cash or it's paper equivalent (MO, cashiers check). When they insist on a credit card the scam alert instantly turns on.

In your case I would just notify the credit card company that you received unordered merchandise and demand a credit. The seller must produce a WRITTEN order from the buyer confirming the purchase to prevent the credit chargeback from happening. Verbal (phone) orders are basically unverifiable. Recordings are equally unverifiable.
