THE PRACTICES EXPOSED in Report #631488 ARE A SCAM TARGETING "Desperate Housewives"/Job Applicants interested in driving mobile catering routes for this Quick Industrial Leasing, Inc.
Quick Industrial Leasing, Inc. misclassified Mobile Catering Truck Drivers as " Independent Contractors". Vinnie Pecht has rebutted this statement contending that the Catering Truck Driver's are Independent Contractors. The facts are, there is one (male) driver who is currently on the payroll, called an employee, and for whom payroll related taxes are paid. There are three female, and one male driver in addition to this employee. All four are misclassified as Independent Contractors. They do the same job as the male driver, with the exception of training new drivers.
Spokane/ CDA Craigslist Ad #2, listing Mobile Routes for Sale appears to be a new SCAM, by Quick Industrial Catering/ Quick Industrial Leasing, Inc.
WA State Licensing Records indicate these are three separate companies operating from the same location, same family/ related owners, interdependent on one another and conducting their business in the Spokane, WA area.
* Quick Industrial Catering posted the ad below soliciting "Desperate Housewives"
to become Mobile Catering Truck Drivers driving catering routes in Spokane, Wa
for Quick Industrial Catering, Spokane, Quick Industrial Leasing, Inc., and selling
food from these mobile catering trucks produced at Quick Industrial's Commissary,
Sunrise Foods Wholesale, Inc.
* Days later...Quick Industrial Catering posted Ad #2, offering for sale the
same routes. The very same routes currently leased out to the "Desperate
Housewives" as "their own mobile catering route". It is apparent the routes
are not their own, but the property of Quick Industrial Leasing, Inc. The drivers
are always at risk of loosing "their own route" because they are always for sale.
BUYER BEWARE: Potential buyers should consider the following facts:
1.) When you buy a route, you are not buying ownership of a territory or
area, you are simply buying a customer list of business' who agree to
allow a catering truck to solicit on their property. You do not own
an exclusive right to solicit these companies, the area, the territory,
you own a customer list that tells you who and where the companies
are. Get an objective consultant who can build a route for you for you
for less than $25,000. Better yet, build it yourself, your customers
will love it.
2.) There is nothing to stop another catering truck driver from soliciting in
the same area, soliciting the same business', and competing for the
same customers on that list you're paying $25,000 to $40,000 for.
3.) It is a violation of Federal and State Anti Trust Law (Sherman Act)
to attempt ownership/ monopolization of market share or sales
area/ territory, or to attempt to restrict free trade. For further
information and clarification regarding Anti Trust Law, Market Share
Control, and Monopolies, contact Spokane Assistant to WA State
Attorney General (509) 456-2496. You will not "own" the route.
Therefore, the selling of a route is nothing other than providing a
(potential) buyer with a list of (potential) customers/ business' to
solicit for business. You don't own a route, you own a customer list,
vulnerable and open to competition by anyone.
4.) Catering Truck Driver's traditionally rent space at Licensed
Commissaries. Licensed Commissaries provide overnight parking,
facilities to clean and sanitize the truck, gray water disposal, ice,
cold and frozen storage, bathrooms, etc. This is common
information is available through the Spokane County Health
Department or any county health department.
5.) Renting a space as described above at a Licensed Commissary is
entirely different from being obligated by contract to purchase food
and beverages exclusively from one purveyor as suggested in the Ad:
"Let us be your exclusive commissary".
Restaurants typically source food and beverages from many
purveyors to obtain the most competitive prices. One exclusive
purveyor/ supplier puts your catering truck business and profit
under complete control of your supplier. They will control the
price at which you can buy, which means they will control the price
at which you can sell and remain in business.
One exclusive supplier:
* Restricts your ability to bargain for a competitively
discounted wholesale price, and look to many different
sources to save costs of goods to be sold.
* Limits product carried to what one purveyor supplies you,
thereby limiting your ability to cater and customize your
product to your customer's requests.
Supplier Limitation, exclusive commissary, exclusive purveyor rights, and minimum orders as a part of your overall contract are covert
attempts to control your business, and your profit margin. See an
Attorney immediately.
Another issue of consideration to discuss with your Attorney is the
circular relationship created by buying a vehicle from Quick Industrial
Leasing, keeping that vehicle on their premises, and letting them be
"your exclusive commissary."
* Quick Industrial Leasing, Inc. / Quick Industrial Catering
and their employees equal direct competitor. They have
"35 years of history serving the Spokane area". Why
entirely give up a territory? You are buying what amounts
to a customer list. There is nothing to prevent QIL from
sending an employee out in a Quick Industrial Truck to
compete against you at any business in your area not
included in the customer or business list. All the trucks
look the same. The customer's don't know the difference
unless you differentiate yourself and brand your business.
If all the food on the trucks is from the same commissary
the customers believe the same company is running all
the trucks. You will appear to be "just another Driver".
Quick Industrial will be your "exclusive commissary."
Meanwhile what if you can't or don't want to meet a
guaranteed minimum daily commissary order? What if you
find their food is 40% more than it would cost you to
buy from other food suppliers? What if you don't want to
buy from them anymore? Will they send their driver's
out to undercut you? Will they force you to buy more than
you can sell because of contractual obligations? Will they
you? Who has all the options, you the "business owner", or
Quick Industrial?
* If your business fails, they will "repossess" the truck, and
hold you liable for failure to follow through and fulfill the
contract. They will loose nothing. They get the truck
back, they take back the route/ customer list. They've still
sold food to you that would have gone to that route via
one of the misclassified Catering Truck Drivers. It doesn't
matter how the food gets to the route. What matters is if
the food is sold from the commissary to an outside
customer. The more food sold, the more the commissary
makes, the more the entire company makes, because they
are all one. If you sign a non-compete agreement with
them, you are dead on arrival.
wi You will not be able to open up outside their
control. You will loose your business unless you move to
another city. (Which will negate the entire purpose of
buying that customer list.) And last, you will
get a bill itemizing what you owe them. Pay immediately,
or risk your debt being sold to Associated Credit
Collections, Spokane Valley, Wa.
* This is a lucrative SCAM. How many mobile catering routes
do you see in Spokane, WA? How many mobile catering
trucks are operating with an Owner/ Driver who purchased
a route and truck from Quick Industrial Catering? In 35
years of business (quote), there should be some mobile
catering routes operating in Spokane, WA, purchased from
Quick Industrial Leasing, Inc. To my knowledge there are
none. This company states, we are "Spokane's Mobile
Catering Headquarters". I wonder how this happened?
THE SMART BUSINESS PERSON OR CATERING TRUCK DRIVER WILL EXERCISE EVERY CAUTION IN ANY CONTRACTS OR AGREEMENTS WITH THIS COMPANY.
* Have an Attorney thoroughly go over and edit Contracts prior to signing.
* Request an Accountant thoroughly audit the past 5 years of all catering truck
sales, not by truck number, but by route number. Many of the routes have
not been in operation for years because they are non-viable.
* Do Not sign a Non Compete Agreement under any circumstances. This is key
to maintaining monopoly of market share.
* Attempt to investigate past and present Catering Driver experiences.
Drivers are in unloading their trucks, and putting in commissary orders by
12:45 pm M-F. They usually leave the truck yard and enter their cars by 1:00
pm. Ask the girls if they made any money that day?
* Unless you make a point of repainting your truck and
branding your business, every day you are out driving a
green Ford F250, or a white Ford F350 that says,
"Supplied by Quick Industrial Catering", you are branding
their business, not your own. Companies will believe you
work for them, or represent them, and when/ if you fail,
they will seamlessly take over the route, and you will
be the one who looses.
