Dear Mr Sacci:

On Tuesday, February 19, 2008, I was checking on the above-referenced house that I contracted Wilkens Real Estate to list and sell for me. During that visit I noticed the bedroom door was smashed, the hinges were ripped from the adjacent woodwork, the trim, molding, and door frame all sustained damage. I immediately called the listing agent from your office , Ms. Cynthia Nobles. Ms. Nobles advised me that she received a call from Ms. Melissa Corea, Remax of the Poconos, approximately 7-10 days earlier stating that during a showing she and her client were in a bedroom together and the door would not open. They proceeded to knock the door down causing the above-mentioned damage. Please note that I was never notified by Wilkens Real Estate or Remax of the Poconos of any damage to my home.

On February 19, 2008, I called Melissa Corea, the agent from Remax of the Poconos, who was showing the house with her client when the damage occurred. During our conversation, Ms Corea stated that her client "was checking that the door and the door frame met Section 8 rental requirements" and then they had both gotten locked in the bedroom somehow. After a period of time locked in the bedroom Ms. Corea allowed her client which she refuses to name to break down the door. Please be advised that there have been people living there, dozens of showings and a visit from a realtor caravan without ever a mention of any problems or concerns with the bedroom door. I find it noteworthy that her client was checking & testing doors for section 8 suitability and all of a sudden the door just suddenly decides not to open.

Based on what I saw during my visit and conversations I had with both Ms. Nobles and Ms. Corea I have the following concerns:

Why did Ms. Corea allow her client to knock down my door? She had the responsibility to be aware of what her client was doing at all times while in my home. Why did Ms. Corea wait until after she allowed her client to damage my property to alledgedly call Ms. Nobles?

Ms. Corea could have easily called while in the bedroom and Ms. Nobles or another Wilkens representative could have come to let her and the man out of the bedroom. Why was I not notified of any damage to my home? If I had not gone there I would have never found out meanwhile there may have been showings and prospective buyers would certainly look unfavorably at busted down doors and wood work. Why did Ms. Corea refuse to give me name of man who she allowed to smash my door and woodwork? Due to the damage I may have to file a police report and Ms. Corea and Remax of the Poconos should cooperate as they allowed the damage to occur while they had care, custody, and control of my home.

To resolve the problem, I would appreciate my door replaced and the woodwork and molding repaired.

I look forward to a prompt reply and resolution to my problem and will wait until Monday February 24, 2008, before filing a police report, seeking help from consumer protection agencies, better business bureau, franchise headquarters, and state licensing boards.

Update: No response from either Wilkens Agency, Remax of the Poconos, or agent melissa Corea who allowed client to kick door down. Homeowners insurance will not cover damage labeled it vandalism.
