I applied for a loan modification from an ad on TV in April of 2010. I was connected with a company called Rocky Mountain Legal Services, owner DAVID CASTILLO. He has also done business under Fisher Legal Services, Colorado Capital Investment Group, and most recently Rocky Mountain Processing (debt settlement services).

We paid this company over $2500. We were told to communicate only with Rocky Mountain Legal Services and not to contact our mortgage company. After letters of rejection from our mortgage company I finally called our mortgage co. and they said the reason we kept being denied is because we were current on our mortgage.

Castillo said the only reason he took our case on was because he was under the impression that we were $3000 delinquent. We sent him documentation proving the exact opposite. Even one of his affiliates told him in writing we were NOT delinquent. Naturally I demanded a refund which he agreed in writing,was due to me.

He has offered us a refund but refused to pay it. I would call him every week and ask him if our check was in the mail and he would tell me to call the affilliate who took our original application and try to get it from them which was very maddening because they were not the ones responsible for the refund. He even resorted to threatening me with slander and extortion lawsuits.

I have turned this guy over to several different authorities who are currently doing investigations. There are other reports on this website about this scam artist under Colorado Capital Investment Group that have had the same negative experience as we haveand one report that praises his company,(probably from his girlfriend). Everything I have stated in this report I have physical documented proof.

I'm interested in a class action lawsuit. I think there's enough of us out there who are victims of this guy that it may be possible. Delay tactics are their golden goose hoping you will give up and they can keep on keeping on. You work too hard for your moneyfor this parasite to rob you and then shrug your shoulders and move on. Help me stop him. I give Ripoff Report my permission to give out my contact info.

My name is Lydia Taylor. My husband and I used David and his services. Plain and simple they helped process our paperwork, he told us why it got denied in the beginning.

I cannot say enough of this company and how professional they are.

First let me say that we were turned down by the Bank 2 times trying this on our own. Then we were referred by our friend to use this company we did not know what to expect.

I can tell you that we were treated very professionally, and in a very timely manner.

Once we got all the necessary paperwork to this company they explained to us why they process this stuff in a certain way and how they will submit our file.

We got weekly updates and we always got in touch with the employee handling our file.

I WILL RECOMMEND THIS COMPANY TO ANYBODY WHO WANTS A RECOMMENDATION.

Thanks Dave and Staff thank you very MUCH we are very pleased.

I have read this complaint from this person, and all I can say is if you read their complaint it seems they are not happy with a third party company not RMLS or anybody else.

My husband and i used this service to help with our modification to our property, and we were not misled in any fashion. I will say our experience was just the opposite.

Our scenario. We went through a 3rd party who connected us with RMLS. We were given a very detailed welcome package. Our contract was gone over with us thoroughly. I dont know what this persons contract says, but our contract states there is no guarantee and in no way shape or form did RMLS give is any bad advice nor did they steer us in any bad direction.

We had tried to do this with the bank for quite some time and we got nowhere. Then we decided to seek a company or attorney to help us.

We were assigned to RMLS as our processing company. We as the consumer did our due diligence and checked up on the attorney who was supervising the file and we were satisfied with the attorney being a licensed attorney. We even spoke to the attorney, and again we were satisfied.

We were provided with weekly updates and i can tell you this process is not easy and it has been very frustrating but i can tell you this company saved our home and we were able to get out lives back on track.

In our welcome package it gives you a direct number to Mr. Castillo and direct email address if at anytime we wanted to get any clarification on what was happening.

I can say he was very truthful and I would say sometimes too truthful on the process of trying to do a modification. All I can say is we appreciated his honesty regarding this process now I cannot speak for this Mirium lady, but it seems she is a bitter person and she is trying to put a black mark on this company because her 3rd party misled her or input wrong information into their information system.

I would recommend Mr. Castillo and his company to anybody who wanted a recommendation. I will provide you with our contract which clearly shows there is no guarantee and from what we can tell discloses everything that this contract should disclose.

My husband and I rate this COMPANY AAA in our book.

To the Lady who made this complaint: It sounds like your 3rd party company did you wrong. You should apologize to this company and the owner and should be ashamed of what you are trying to do. If you read your complaint it shows that you are in the wrong here. There are two sides to the story and from my view I say you are definately wrong here lady.

I am reading your complaint over and over again and you are very vague in we and who told you to do what. I will bet anything that your 3rd party company told you to do things....because everything you are mentioning in your complaint is circumstantial and without substance.

We recommended our neighborhood friends to this companylast yearand I know a few of them also had very favorable experience as well.

Again we would rate our our exerience as AAA......Thank you for helping us we appreciate all your hard work. We are very happy with your service. God Bless.

Apparently Mr.Castillo chooses not to follow the rebuttal guidelines as they state you are not to give out addresses and are not to make false statements. It is not surprising that he does not comply and is further proof of his dishonesty. Mr. Castillo claims Full Circle Solutions gave him incorrect information. Modtrak is the customer client management software developed by David Castillo that was used to monitor files. Full Cirlce Solutions claims they did not have access to this system and that the information was submitted by RMLS.

The supervising attorneys of RMLSboth sent us letters of resignation from representation of RMLS because of compliance and conduct issues regarding Mr. Castillos business. Apparently we are not the only ones whoare dissatisfied with his business ethics.

He wanted me to send out letters of retraction to entities I had contacted regarding this unpleasant experience as a condition of a refund. I was willing to let these entities know that the issue had been resolved AFTER we received our refund that Mr. Castillo promised to us in writing but he was not willing to compromise. I was not willing to send out letters of retraction because everything I have stated is true and can be verified with Mr. Castillos own e-mail correspondence with us.

We did in fact read our welcome package and our contract. For Mr Castillo to claim otherwise is his way of defending his unethical behavior. The source of the conflict lies with RMLS knowing that we would be denied based upon the information provided and falsifying our documents.

Mr Castillo continually threatens us with law suits and I hope he does as I'm sure a counter suit is the only way we will receive our money he agrees he owes us. One of the attorneys that severed his relationship with RMLS writes "Fischer Legal Services never entered into any agreements with Full Circle Solutions or any other affiliate of RMLS. David Castillo, RMLS, CCIG, nor any other third party, EVER had the authority to enter into any agreements on behalf of Fischer Legal Services. Upon learning of this confusion I immediately notified FCS that Fischer Legal Services never entered into an agreement with his company. Consequently, the possibility that someone was creating agreements naming my firm as a party without my permission is of great concern."

Honest business people don't have to change their name and address as often as Mr. Castillo and they don't have their attorneys resigning for no reason. Mr. Castillos rebuttal to my original report is full of falsehoods and I believe after the evidence put forth in this statment it is pretty obvious who the dishonest and DIFFICULT one is in this whole scenerio.

Good Morning

My name is Olga Miniuk and I live in San Diego California. I was contacted by an Employee of RMLS regarding this report. I was asked if I would comment on my experience with them.

I am more than happy to report that this company is the best thing that ever happened to me and my family.

After I read this report I must say that we have had a complete opposite experience with RMLS and how they handled our request for a Modification.

First let me explain my husband and I were denied for our Loan Modification after trying to do it ourself. We were told by our bank that they did not get documents on time in order to continue to process our request. We were working with our bank for over 1 year with no results. As I was facing foreclosure and getting ready to lose our home due to being severely delinquent we were put in contact with this company to see if they could help us.

The employee explained that they could not guarantee anything. They were very thorough in their explanation including sending us a Detailed welcome package.

As we had a sales date on our property we figured why not lets give it one more time.

I am happy to say that not only did this company get the Sales Date stopped and postponed on 3 occasions we just recently received our Loan Modification paperwork in the mail. Paperwork that I have told this company they can share with anybody as long as our address was blacked out. We had a loan with Indy Mac bank at a rate of 8% and a payment of 3500 per month. Our paperwork that we signed has a new payment of 2155.98. This modification even wiped our delinquent amount away and we are now current on our mortgage.

I can comment only on my experience. I find this process very, very stressful. I had lost many nights of sleep, but now we get to keep our property and get a fresh start because of this company.

I can only say we were not misled nor did they promise anything. Actually it was quite the opposite. It was like they tried t talk us out of doing this, but we figured we had nothing to lose.

We are COMPLETELY SATISFIED WITH the treatment and Customer service we received. I have a complete three page list of notes from them on updates and emails.

We have recommended a few people to them in the past and from what I know they are happy and satisfied as well.

One last note. My husband and I also signed up with their debt settlement service and again we are satisfied beyond what we expected.

Althought I did not work directly with Mr. Castillo we did emailhim on a few occasions andhe did respond directly and also offered his direct phone number if the emails did not answer our questions. We felt no need to call him as his answers were exactly what we were looking for.

If anybody should get complaints it should be the Banks.We looked up how many complaints Indy Mac Bank has and I cannot believe they are still in business they were in the hundreds.

This Clients name is Mirium Foese who resides at 721 Mamer Road in Spokane Washington 99216.

1. Fact. Client contracted through a 3rd Party named Full Circle Solutions with John Mahr and Layton Ward. This company was terminted from our program last year as they were caught inputing false information into our system ( in this clients case they stated client was delinquent on mortgage). They were not.

2. RMLS Employees never told this client to never contact their mortgage company. Our welcome package and Legal Contract ( supervised by Elizabether Leder) the attorney who supervised this contract clearly states that we encourage every client to speak to mortgage company etc. ( We have the full contract signed by Mirium Froese and the Welcome Package that explains the process in DETAIL.

3. We also have the signed documents from the client that states a Modification is not a guarantee regardless of outcome.

4. Fact. Even though we were not the contracting party we offered a refund to be paid to client in return for the client to sign a letter that we have done nothing wrong.

5. FACT. I myself did not prequlify this File. This file was prequalifed by one of our supervising attorneys and RMLS employee. I as the owern called Mirium Froese and offered on several occasions to work with her in every capacity refund her money and provide her with every possible Client Satisfaction possible. EVERYTIME I SPOKE TO HER SHE WOULD ONLY CURSE AND CALL US NAMES ON ON SEVERAL OCCASIONS we would only speak to her husband. We have spoken to her husband and offered a refund to him as well he was happy and ok with us refunding, but stated that his wife Mirium is a difficult woman to deal with.

6. Fact our corporate attorney has and will file a CIViL lawsuit for Slander against this party in the next 30 Calendar days.

7. We have done loan modifications for over 5 years we have received 9 TOTAL complaints 4 of theM were not for our company but a similar name. The remaining complaints were similar to this one as the client provided false information to their 3rd party company or the 3rd Party company that contracted them.

8. Fact. RMLS provided this client with every opportunity to settle with us including us offering a refund even though our contract states we are not the contracting party.

Summation: We have serviceD several clients and our phone line is always open to our clients. On occasion I call clients to make sure they read the contract and the welcome package that is provided for processing services. This client chose not to read the contract nor did she read the WELCOME PACKAGE which I can provide to any party.

EVERY CLIENT RECEIVES A WELCOME PACKAGE EXPLAINING THE MODIFICAITON PROCESS. IT HAS OUR DIRECT CUSTOMER SERVICE DIRECT NUMBER AND EMAIL ADDRESS.

We have satisfied every complaint and have proved on every complaint and we can prove on this complaint that THIS IS A FALSE COMPLAINT AND INVALID.

Again there is two sides to ever story and it is a PITY when a client due to their own fault and their own accord they choose to resort to this type of behavior.

Our Corporate Attorney is Aware of this and we will Pursue remedy through Legal Channels in Washington State.

As with any Contract we URGE the Client to Read the Contract in detailand if you need to have your attorney review we also encourage. This could have been avoided if this client would have reviewed their contract with the contracting company. In this case they did not.
