Approximately 5 yrs. after Katrina damage New Orleans in 2005, I have been trying to put closure to this dilemma with Delgado Community College and Sallie Mae Financial Bank Institution. June 1, 2006 the former Attorney General, Charles C. Foti, Jr. forwarded a collection letter to my address in Texas, requesting the principal fee of $4,030.22 on a past due student loan plus other fees and interest in the amount of $5,240.41 due to FYI received from Byron T. Henderson--former LOSFA  Administrator for "Default Recoveries section in Baton Rouge, LA. I called the Attorney General Office, his assistant suggested that I called the LOSFA office and speak with him but both agency were informed of the balance have been paid. After speaking to Henderson I contacted my bank and requested to speak with a Teller from the East Lake location but there building was destroyed by the storm and every Teller was placed in different banks locations of the city. The Teller was located, she contacted me and faxed a copy of the "Cashier Check Receipt" and I faxed a copy to Henderson. Then Henderson, familiar with the system had faxed a copy to SLM,they paid Henderson $4,223.05 on a proven non-defaulted loan. I asked Henderson to assist me in receiving the reimbursement on a loan over payment but he, "wish me luck"! On April 7, 2005 a certified letter was forwarded to SLM, within the envelope was a Cashier Check in the amount of $4,167.61 paid-in-full on the student loan, plus 4 other payments of $42 each were already rendered on the account before I cleared the balance. SLM never recognized those payments or investigated my complaint because after adding outstanding fees including the $4,000 I never received, SLM forwarded a $89.92 refund.



The Cashier Check was misplaced by SLM Representive because the postal certified card was not signed but stamped. SLM was never assured of who accepted the letter and could not justified the check location but supplied false information to the Grantor on a non-defaulted loan. SLM stated, "that no account information was indicated on the check" but the bank name on the check was never notified by SLM. All disclosed information have been deceptive by SLM in repaying and holding my funds from the loan over payment. I wrote 30+ letters/called/faxed to every government agency and TransUnion Credit Bureau you could imagine, due to SLM placing the $4,000 in my crfedit file. TransUnion was contact three times in the removal of a false report but they informed me that they have to wait on the Creditor approval. Germaine Edwards and Delgado's Chancellor are both at fault for holding students loan checks over 2 years for interest, without notifying students during the semester of their loan checks. Delgado forwarded and disburse only half of the amount of checks to Chase Bank and placing all students in this perdictiment. Chase Bank notified SLM and Henderson of Delgado actions before Henderson addressed the Attorney General Office. C.E Andrews appointed Lorraine Heydt and Lisa Dowling to investigate the case but to no avail and no truth to there findings.



I contacted the US Dept of Education--SFA Ombudsman Office but they were in agreement, closed the case because of my signatures needed based on two checks total $3,213.61 that is not my signatures. Why was my bank account number indicated on those checks if Delgado disbursed $1,313.00 in the Spring (10/26/99)semester, reported by Michael Jacobs. Steven Zeringue stated to the LA Attorney General that the signatures or similar and I was not at Delgado during time indicated by SLM but he never stated on the missing $2,000.00 or the responsibility of Delgado reimbursing SLM of those students funds. Due to my persistence and not being at fault, TransUnion removed the false report but SLM have not taken the initiative to reimburse me or apologize for there actions. All the deceitful actions of Delgado have taken place after their Ex-Clerk sentenced for pocketing $44,600 of Financial Aid Students Loan Checks...but Delgado have never forwarded a listing of students names who checks were forged during that process or during the time loan checks were placed on deposit for interesr that the school received. Also,I'd signed 2 forms (Promissory Note/Proof of Forged) due to the complaint of fraud and the non-defaulted loan but as of today, no avail on a response from C.E. Andrews, President of SLM or my refund.
