Complaint Review: Shellco Credit Systems Ltd - Concord Ontario

I won't tell the whole story as it's very long but, here are the facts:

Shellco says I owe them $5000.00 from a rent contract.

I contacted the rent company to find out why I owed the money and they were giving me run around answers that didn't make sense...things like I didn't pick up after my dog while I lived there...things like that that I don't understand where $5000.00 comes into play.

I contacted a lawyer. In the meantime Shellco credit has posted this amount on my credit file as owing in collections.

my lawyer sent both Shellco and the rent company a letter saying that if they wanted to sue me for anything they had to file a court case with the rental court and a judge must decide if I owe the money or not. Especially, since my lawyer could not get any straight answer as to why I owed the money in the first place. He also told them that they must remove the amount from my credit bureau until it goes to court and the judge decides.

The rent company after many calls from my lawyer finally decided to follow proper procedure and file at the rent courthouse for a court date. This allowed me to countersue against the company.

As I now had a trail case number a letter was sent on my behalf again telling them to remove the amount off my credit file which they never did.

My lawyer sent a letter to Equifax with a copy of my paper from the court house with the trail case number on it and requested that they remove this false information from my credit bureau which they refused to do saying that they had to get permission from Shellco to remove it which makes absolutely no sense at all.

My lawyer also stated in the letter that they are not to contact me anymore and that all communications should go through him.

After I spent $2000.00 in lawyer fees Shellco has called me and harassed me numerous times.

They have been yelling at me.. Swearing at me, calling me names, telling me I'm a deadbeat f*cking idiot and that I'm stupid. They told me and I quote "We will just keep f*cking with your credit and f*cking with your credit until youre so f*cked that you can't afford to live anymore." They have called me at work as well as at home every day of the week. They have threatened my job all of which I have the recordings taped. They have threatened to garnish my wages and obtain a judgement against me. They have threatened to screw my credit for the next 20 years.

3 months after Shellco appeared on my credit bureau my visa was up for renewal. I got a call saying they would not be renewing my visa due to recent information from a third party. I have never missed or been late for a payment and my balance was at zero. I had that card for 9 years.

I got denied for a mortgage as well as a car. I sent more repeat letters to Equifax with my court papers stating that the amount was being disputed in court with the registered trial number requesting that they remove the information from my credit file but, no luck.

Then Shellco sent me a letter in the mail saying that they had obtained a judgement on me with a case number and said it was passed in a court in front of a judge. Since I had no knowledge of this, I went to the court with the paper and had them run my name as well as the judgement letter and nothing came up. They told me that it was a false letter and that nowhere in their system was I coming up. It simply didn't exist.

My trail date is still not set. Apparently it can take as long as 3 years to get a date for trial. What am I supposed to do in the meantime? This has already been on my credit for 3 years and I am still waiting for a court date.

I can't afford to spend any more money on lawyer fees for letters that do nothing and I have been going around in circles.

Fernando Ferreira is the collections person that keeps calling me. Today he called me 14 times in total and left me 3 messages at work.

Fernando keeps fishing around in my credit for things. I dont know how he knows all of this personal information about me like how much money I make, what I owe on my new visa, where I work, who my customers are, who I live with, the names of my family members and where they live. He has actually phoned my work and started asking random questions about me and my job. It is very scary and I am actually afraid.

It is starting to affect my job as well as my life and people around me. I dont know how else to proceed to get this off my credit file and I dont understand Equifaxs procedure for removing this. What more information do they need?

I dont understand how this company is allowed to get away with all these things. It doesnt make sense to me.

Now Shellco called me again and told me that they will be adding on $900.00 in legal fees to my balance plus interest if I dont drop the court case against the rental company.

I know I will win in court but, I am having a hard time waiting for a court date. What am I supposed to do in the meantime? It is really affecting my life.
