I have a lawsuit pending against one of Sherman's minions. They hired a collection agency to collect a debt that I do not owe and at the same time trying to collect it themselves. I thought that it was illegal for a company to hire two collection agencies to collect on the same debt at the same time. I was recently told that Sherman Acquisitions just settled a class action case in Illinois. Please check with the Illinois Attorney General for additional details. This company helps collection agencies to be supposedly compliant in their collection efforts. I had a similar problem with Sherman a couple of years ago. I believe I was one of the first people to fight them over it and win. OK, here is some advice for you: 1: The burden of proof is on them, not you. Your request for Validation of he Debt should be in writing sent CMRRR. In it you will (a) dispute the debt, (b) Demand Proper validation (more on this later), (c) Instruct them that all communication is to be in writing, no phone calls and (d) taht you will enforce your rights under law vigorously. 2. DO NOT SEND THEM ANYTHING. They purchase multi-million dollar portfolios of debts that were charged off and usually get absolutely NO documentation except a computer tape that says "Consumer XYZ owes us $XXXX.XX". 3. The 30-day period the collector at Sherman alluded to does NOT state that if you don't dispute it within 30 days you owe it - it is a part of the Federal Fair Debt Collection Practices Act (FDCPA) that allows them to "consider the debt valid". The FDCPA specifically states that failure to exercise rights within the 30 days is NOT an admission of the debt. 4. Sherman has begun the practice of sending out "affidavits" citing the 4th Circuit Case of Chaudhry v. Gallerizzo when asked for Validation of the debt. The "affidavit" merely states "yep, you owe it". These "affidavits" are NOT validation. They are continued collection activity. 5. I realize it is Ripoff Report's policy to not allow links to other sites. That said, there is one web site in particular you should visit - it is "ArtofCredit" dot com. Art of Credit has several threads on how to handle Sherman and the results. It costs nothing to join, and there is a wealth of information on how to handle Sherman there. I suggest you read "The Flyingifr Method of Aggressive Credit Repair" in the "Credit" section (do a search). That thread was written specifically to point newbies in the right direction. Just so you will know, I am Flyingifr at AoC. Sherman did the same thing to me, and when I got finished with them they deleted the trade line AND paid me $1000 for the insult. There are at least a half a dozen members of AoC who have also been paid money by Sherman.
