Complaint Review: strax rejuvenation - Florida

1.     Breast lift&Brachioplasty done on December 13, 2013:

a.     Based on Claimant’s witness, Strax did not inform Claimant of failed surgeries& continuing sagging breasts after breast lift surgery. Strax did not allow Claimant to read consent forms. Strax still has not provided following medical records to Claimant: 1. Dr. Zeichner’s dictated MEDICAL INFORMATION/ measurements needed in PATIENT’S CHART to Daniella Ramirez (non-medical financial counselor/SALESMAN) proving STRAX did not keep accurate medical records. 2. Medical record from March 20, 2014, when Dr. Zeichner injecting entire syringe of steroids in Claimant’s Right upper arm.

b.     Strax Rejuvenation care of Dr. Erogul measurements/prescriptions from December 5, 2013-Dec 12, 2013. Dr. Erogul’s measurements were 26cm on right breast &27cm  left breast which means that left breast needed to be lifted more than right breast. Claimant’s alleges that from Dec 5-Dec 13, Dr. Zeichner did not review Dr. Erogul’s measurements or review Dr. Zeichner’s own MEDICAL INFORMATION/ measurements  dictated to Daniella Ramirez (non-medical financial counselor/SALESMAN).  (count 1)

c.      Strax Rejuvenation care of Dr. Zeichner from December 13, 2103-steroid injections on March 20, 2014

d.     Claimant purposefully SCHEDULED TO HAVE SURGERY AT 9am at Surgery Center of Broward December 13, 2013 but it was from 11:30am-5pm

e.      Dr. Zeichner did not mark back of left arm straight across causing Claimant to have deformed left arm. Only fat grafting can be performed by 2 plastic surgeons. (count 4)

f.       Dr. Zeichner marked right breast with a higher mark for higher areola but did not mark left breast with a small higher mark so areola would be same as higher right breast. (count 2) If Dr. Erogul’s measurments & Dr. Zeichner’s dictated measurements  to Daniella Ramirez not a REGISTERED NURSE(which HAVE BEEN LOST/NOT PROVIDED BY STRAX)( show that left breast was larger, then Dr. Zeichner should have taken more skin from below left breast than right breast. Dr. Zeichner did not use the skill&diligence a plastic surgeon with his experience should have used in surgery on Claimant. DR. ZEICHNER’S MISSING STITCHES LEAVING 2 HUGE HOLES IN Claimant’s LEFT BREAST. Surgical records state that Dr. Zeichner started on right arm/breast &did left arm/breast. Claimant alleges that he used less care on left side than right.  (count 7)

g.     Strax did not allow ADEQUATE patient-surgeon communication. Dr. Zeichner asked Claimant RIGHT IN PREOP CURTAINED CUBICAL (WHICH SHOWS THAT CLAIMANT & DR. had not discussed anything before the breast lift surgery) if she wanted a breast reduction. Claimant said no because: she didn’t know if Strax Rejuvenation would charge me extra for breast reduction, she didn’t know how much the breast would be reduced, she HAD NEVER DISCUSSED A BREAST REDUCTION AT ALL BEFORE SURGERY or if Dr. Zeichner would have done it as part of breast lift surgery.

h.     Dr. Ziechner CUT ARM PITS WHEN CLAIMANT SPECIFICALLY TOLD DR. ZEICHNER NOT TO CUT ARM PITS When Dr. Zeichner did not answer, Claimant assumed that he would not cut into her arm pits. Dr. Ziechner left 2 LARGE TUCKS OF SKIN tucks under right arm. Claimant has (seen by Dermatologist) INGROWN SKIN IN RIGHT ARM PIT. (count 5)

i.        “When performing Liposuction on a patient’s arms, several items should have been considered. Postoperative anti-inflammatory drugs such as Cox 2 Inhibiters may be given for 5-7 days; specialized compression garments, binders, and tape help to reduce bruising, hematomas, seromas, &pain. Generally, compression is recommended for 2 weeks.” (count 6)

j.       Dr. Zeichner injected only right arm with entire syringe of steroids on March 20, 2014. Claimant’s 1/8” thin red scar widened to ½ “&atrophy of skin& muscle BECAUSE TOO MUCH steroid was injected in Claimant’s right arm. “Initial steroid dosage should be .1 mL is injected per sq cm of involved skin”.  “Wide scars need to be surgically revised, Raised scars I recommend topical silicone gel strips, Red Scars can be lightened using IPL or bleaching creams”. (count 8)

k.     Based on Claimant’s review of medical records&her witness of Dr. Zeichner’s care, it is Claimant’s opinion within a reasonable degree of medical probability, reasonable grounds exist to initiate a medical negligence claim against Dr. Zeichner &Strax Rejuvenation for breach of standard of care CAUSING patient to have to undergo all risks associated with breast revision surgery/scar revision/fat grafting to left arm.
