In the world of ever changing retail landscape and toys retailing there are new practices that completely destroy the notion of warranty and implied and explicit guarantee to the consumers who purchase products. I recently came across the product from Hong Kong-based Buzz Bee Toys (HK) Ltd called Air Blaster, a similar product to everpresent Nerf Guns that are favorite means of "combat training" for crowd 8 years and younger. Despite the product purchased at Target in IL came with explicit 1 yr warranty the product failed after approx 6 weeks of usage. When I contacted the BB Toys I was told that the company will send out the failed part but with catch that parent would have to disassemble and assemble the product themselves. When I responded that I neither have a skill or time to engage in this type of micro-manufacturing I was again told that the product can be replaced upon receipt of the defective part but with a catch that the shipping cost that in this case exceeds price of the product would have to be a born by a customer. The company representative also stated that ocassionally they can be generous on case by case basis and could eventually reimburse the cost of shipping by throwing in some.............extra darts. With this response I contacted Target Inc for comment requesting to no avail their vendor ethics and practices code. Despite several emails the code was not provided leading one to assumption that Target Inc is de-facto completely fine with its products being sold as is just like anyone would purchase a used car from a questionable used car lot.

But wait the consumer hell of unmet expectations gets better. For years now Staples Inc is selling software and many other products with a rebate system that is outsourced to its vendor , Parago Inc. The consumers often receive all of part of the purchase price by rebate in form of prepaid Visa cards that are issued by South Dakota-based and not a stranger to federal regulatory action , MetaBank. The payment card systems have been recently faced by various state AGs due to many employers starting offering the cards to their empoyees as electronic paycheck. Unfortunately for employees many cards came with fees bringing their earnings below legal and mandatory state and federal minimum wage. The cards were especially targeted toward unbanked low income population and minorities whose income lags even in the best of times. In my case I have received a refund for a purchase made on Ebay to my card that actually disappeared despite an electronic record of funds being sent back to the card. When I called MetaBank I was informed by their overseas call center representative that the bank can hold my funds upto 30 days until crediting my card account. Once again I called Staples Inc to informed them how this practice squares with their vendor and ethics policy and received no response.

The bottom line is that in the new reality economy or hit and run retailing, nothing is what it seems and the practice based on respect and basic precept of ethics and morality is history. We are now back to the prehistoric times of hunters and gatherers.
