My daughter and granddaughter are trying to rent an apartment. She called the oaks apartments in Mesa. 526 w Rio Salado Pkwy. She spoke to Glenda. She told Glenda the details of her felony. Glenda said she would list it under my granddaughters name. She also said some felons are allowed.

Glenda called me and I gave her my credit card for $140. $100 to hold the apartment and $40 for the application. As soon as her boss saw the application he said no. Glenda knew it wasn't ok. But she took my money and then said they wouldn't rent to my daughter. I believe it is fraud.

She said she would give back $100. But not the $40. How many people has she done this to. Making $40 for doing nothing is a pretty good scam. She knew her boss would say no, that's why she said she would put it under my granddaughter s name. As soon as Glenda's boss saw the application he said no. Glenda was trying to do something which was not allowed.

Now she wants to keep the $40 application fee. I say that's fraud. I want my money back. And actually it was $140. But she did say she would refund $100 but not the $40.

Application fees like the one you're talking about are generally non-refundable simply because the property management company incurs a cost to run the application, including checking the credit of the named person on the apartment.  If I had to guess based on your narrative, your daughter has poor credit and your granddaughter either has poor credit or no credit.  That's why the application likely failed.  That's why someone said no.

Apartments make money for their owners when the property is rented out, not when someone fills out an application that fails; nobody is going to get rich on a $40 application fee for which the property company spends about $40 doing the investigation.  Apartments lose money when they rent out their property to less than upstanding people, which is why there are application fees and credit checks run.

This would not be fraud...

....you tried to bribe someone in a rental office to process a fraudulent renter's application, and when she got caught, the fraud fell through.  And now you want your bribe back.  

"Glenda was doing something which was not allowed." And you were completely aware of this fact.  Which explains the extra $100.

You have two choices here- you can talk to Glenda's boss and explain the situation and try to get the $40.  Seems to me that rental applications should not be non-refundable.   Or you can go to small claims court and tell a judge that it's not fair that Glenda accepted a bribe and then couldn't follow through.  Good luck.
