Please beware if this company that's claiming to be private mortgage lenders!  They ask you for an upfront fee of anywhere between $2500-$3500.  First of all, according to the FTC (Federal Trade Commission) it's a scam and illegal if any mortgage institution asks for an upfront fee to acquire a loan.  A down payment is totally different.  The company is registered with the state as a truck driving/transportation company and not a mortgage company.  Therefore they are breaking the law just by offering loans.  Myself and several others have paid the upfront fee in hopes of closing in 30-45 days as promised but Mr. Gaylin Ware is a liar and gives people the run around.  He promises that people will close in 30-45 days and then gets mad and defensive when someone asks him about it.  I know people who have been under contract for 4 months!!  If you some across him or any of his affiliates then run!  He'll try to intimidate you and if you're not smart then you'll fall right into it.

ATLANTA—A New York broker has been indicted for conspiring to defraud 350 financially strapped customers of more than $1.2 million. Kenneth J. Enrico, 46, of Bohemia, New York, was arraigned today on a federal indictment before United States Magistrate Janet F. King on one count of conspiracy, three counts of mail fraud, and 13 counts of wire fraud. The federal grand jury indicted Enrico on February 19, 2013.

“The public is once again reminded that if a deal sounds too good to be true, it usually is,” said United States Attorney Sally Quillian Yates. “The charges against Enrico reflect our continuing commitment to protect our more financially vulnerable victims from the fraudsters who prey upon them.”

According to United States Attorney Yates, the charges and other information presented in court, between June 2011 and August 2012, Enrico offered property buyers private lender loans of 105 percent of the property’s selling price at a 4.99 percent interest rate, regardless of the buyer’s credit score, as long as the buyers had jobs that generated enough income to qualify for the loan amount and monthly payments. Enrico required the buyers to pay him an up-front fee of $2,500 per loan, which he claimed covered loan processing fees and the appraisal. Enrico publicized his offer through several brokers, two of whom were located in the metropolitan Atlanta area. The broker tacked on additional fees.

More than 350 individuals responded to Enrico’s pitch and sent in more than $1.2 million in up-front fees either to Enrico directly or through the brokers. Enrico approved all the buyers for loans. However, none of the buyers ever received a loan from Enrico. He gave the buyers numerous excuses as to why their loans never closed. Not only did the buyers lose the fees paid to Enrico, they lost the earnest money they paid to the sellers of the properties they were trying to buy when their sales contracts expired. The buyers often relied on Enrico’s excuses and entered into sales contracts on second properties with additional earnest money payments, which they later lost when Enrico never funded their loans.

The charges each carry a maximum statutory penalty of 20 years in prison and a fine of up to $250,000. In determining the actual sentence, the court will consider the United States Sentencing Guidelines, which are not binding but provide appropriate sentencing ranges for most offenders.

Members of the public are reminded that the indictment only contains charges. The defendant is presumed innocent of the charges, and it will be the government’s burden to prove his guilt beyond a reasonable doubt at trial.

This case is being investigated by Special Agents of the Federal Bureau of Investigation.

If you live in Georgia, Gaylin Ware and Total Choice Corporation has an order from the department of finance to cease and desist. If they have done business with you they have broken the law and also call the police department there to file a report. Kennth Enrico has no money either. All 3 of these companies are connected and all of them scam. Call the FBI. The more calls the more it will be investigated and they will see the.victims out there.

To all comments regarding Galin Ware, i spoke with him on wed 9/26/12. My wife and i are waiting for r money. Galin said he and his lawyer are speaking with FBI

It been almust 2 months now and no money!

The only reason galin call me back is because i call his cell number and told them ! I am coming for him and kennth Enica and the police will take it from here.

Galin said his is trying to get the money and has pass all files and ask for returns from enico corp They are in long island N.Y.

Do' es anyone know where galin live in ga.

Also miss theresa lopies! who was his loan person! Watch out for here.

I will not stop until i get what i need or someone!

Hi.  I am a realtor.  I have a client who just used SCS Private Funding and it is a huge scam. Please Please Please call the Georgie FBI and file a report.  It will not take but 2 minutes to file it.  I have gathered numerous people to call in so we can stop this and hopefully recover some of your money.  They are taking advantage of innocent people and causing people to literally be homeless.  Please call Georgia FBI at 404 679 9000.  Along with this company, Gaylin Ware with Total Corporation, and Enrico Corpration are involved.  People are using different alias and Linda Kirkland, Scott O'Neil and Scott Milbourne all know this is a scam and they are going to jail.  I am following this through to the end.  I refuse to see these people hurt.

Sorry Mr. Gaylin Ware,

Once again you are incorrect.  The website may say consultants, however you and your parent company, Enrico Corporation are still trying to fund loans.  Mr. Kenneth Enrico needs to be mentioned in this report also.  He is also a crook.  

They'll tell you that you've been approved, then once it comes time to close, they'll blame it on the "servicers".  Servicers are the banks that actually own the loan.  Gaylin uses the "servicers" excuse time and time again until you're tired and want your money back.  Once you ask for your money back, he'll say you have to wait for 30 days and then he takes out "miscellaneous" fees.

My name is Gaylin Ware and I am the majority shareholder of Total Choice Corporation located in Georgia. I have been doing business as Total Choice Corporation since 2003 and helping people obtain investor financing since 2006.  Neither my company nor I or my affiliates have ever had a complaint of any type until  the other day January 17, 2012. We are a private company who help investors obtain residential and commercial property investments.

I agree with the gentleman of the original post about this company. There is also another company associated with this company called SCS Private Funding. I found about them at www.sellmorerealestate.org. After speaking to a representative, Scott Milbourne, about the company, he forwarded an application to my email.

After receiving the application, I noticed Total Choice Corporation noted in a disclaimer so I contacted Mr. Milbourne about it and he stated that Total Choice Coporation is the parent company to SCS Private Funding. I researched both companies and although I couldn't find information on SCS Private Funding, I did find information about Total Choice Corporation. Although they are licensed here in Georgia, since their beginning in early 2000s, they have changed c.e.o's numerous times. Actually every year. As the original complaintant, I also found that they are registered as a trucking company here in Georgia.

I contacted the most recent c.e.o, Gaylin Ware by way of their website. He contacted me back through email asking me to contact his office; however, he provided no phone number. I then contacted him again about the rip off report that I had read above and to give him the opportunity to redeem himself and his company; however, it's been over about a week ago and still no response.

Following my contact with Gaylin, I contacted Scott Milbourne at SCS Private Funding and gave him this information that I had found out about Total Choice Corporation. Needless to say, I haven't heard from him either. Obviously, they are in on this scam together.

I am happy that my husband and I didn't move forward with SCS Private Funding, because I would hate to have to hurt someone about my money. Always ask for licensing information on a company and references. If they can't provide that then leave them alone and if possible report them to authorities.
