My disabled husband and I feel we were ripped off and scammed by Kelly and Christy Wilson of United Country Wilson Realty in Ardmore Oklahoma.

I met Kelly Wilson, owner of United Country Realty, in April 2009.  He responded to a Craigslist ad I placed under the wanted section. The ad stated that my husband and I were looking for someone willing to owner finance us an RV to live in on a full time basis. My husband was 100% disabled which forced us to live on a very fixed income and that caused us to downsize everything. Our best solution seemed to be full time RV living which is much cheaper than home ownership. 

The reason we chose to do business with Kelly Wilson was solely based on the fact the he was a Realtor and franchise owner of United Country Realty, a nationally recognized Agency. He and his wife were business owners and established in their community.  

After responding to the many requests from individuals wanting to owner finance for us and speaking personally with Kelly Wilson and his wife Christy Wilson, we agreed on a down payment and monthly payments. Initially, Kelly wanted us to quickly sign a contract and offered to deliver the RV for us right then and there on the spot.  We had not yet found an RV park.  We initially gave Kelly Wilson $500 with the agreement that we would pay the remainder of the the down payment and first months payment at the time of delivery.  We did exactly that. Kelly delivered the RV and we signed a contract and then gave him the remaining $3000 for the deposit and $325 for first months payment.

We continued to make monthly payments until October 2011. Kelly Wilson contacted me by phone on a Saturday late in the afternoon wanting to meet with me in person.  I had no prior notice of this and my husband was in the hospital at the time as he had just undergone emergency surgery and was still in the Intensive Care Unit.  I told Kelly that it was not a convenient time due to my husband's circumstances.  I finally agreed to leave the hospital and meet with him at our home.

When we met, he promptly notified me that he had filed bankruptcy and needed to return our RV to the bank on Monday.  I could not believe it.  Kelly Wilson stated that he was not leaving without having possession of the RV.  With my husband unable to help me make a decision or advice me on what to do.... and with Kelly Wilson refusing to leave the RV Park without the RV, I felt I had no choice but to comply with his demands.  I didn't have the title to the RV because it was not paid off and Kelly said that he was actually doing me a favor because the bank was going to repo it if he didn't have it back to them by Monday.  He said they wouldn't even give me an opportunity to remove my contents first.

After begging and pleading with this man to at least give me time to find a storage unit the following day because it was now getting dark and I had nowhere to store anything.  He again refused and said I needed to remove my things or he was taking them with the RV.

There was no reasoning with him. So until after midnight with the help of other RVer's in the park, all the contents were removed and just stacked on the RV pad.  Everything was strewn about in haste to get it all out and I had no packing boxes and was unable to find a storage late on a Sat. evening .

Kelly took the RV and left me sitting there with no home and my husband critically ill in the hospital. All this after we had payed him $3500 down and monthly payments for 17 months. He didn't even offer to refund the down payment.  All he could say was, "I am sorry but the bank wants it returned on Monday and I have no choice but to give it to them."  

So it appears that Kelly Wilson sold us property that he didn't actually own. Then to keep himself out of trouble with the bankruptcy court, he kicked us out of an RV that he sold us illegally to cover himself.  I seriously doubt that he even paid any of the money to the bank where he had it financed.  I don't know for sure because he lied to me when I ask him to give me the name of the bank where it was financed. On that Monday after he picked it up, government offices were opened and I was told by the Oklahoma Dept. of Transportation that Oklahoma is a Tax Lien State and he could not legally sell me property that he had a lien on without first paying off the lien.

I know that in these hard economic times there are many creative financing options but I wouldn't recommend that anyone trust the word of a realtor without first consulting with a lawyer.  Especially if that realtor is Kelly Wilson, franchise owner of United Country Wilson Realty in Ardmore, Oklahoma.

You need to press for charges to be brought against this guy for any laws he broke in "selling" you this RV. I don't think bankruptcy would negate anything he may owe you due to fraud or any other criminal actions.

Well that's not quite the truth either.  Kelly Wilson did not fulfill his obligation.
  
He failed to provide current tags. They expired only 2 months after we purchased the trailer.Despite repeated attempts over 16 months time... he never sent them.  He never provided the second key he promised.

The truth is.... he was eager to get his hands on our cash down payment at the time of purchase and made all sorts of promises at that time.

In Dec 2010 we contacted Kelly and asked him if we could change our payment date from the 15th to the first.  My husband receives Social Security payment on the 1st of month and also it was near Christmas.  He agreed that that would be fine.

around June or July 2011 we sent Kelly the trailer payment but he said he never got it.  We always paid by money order so we had to put a trace on that which to date has never been fully investigated as to what happened to that payment.

Then in October.... my husband was ill and I honestly forgot to make the payment and I thought that is what Kelly was wanting to come talk to me about face to face.  I apologized and offered to give him the money after explaining my husbands condition.  Kelly refused to accept the payment for October stating that it wouldn't make a difference and in good faith he couldn't accept the payment because he had filed for bankruptcy and the bank wanted the RV back on Monday.

So if I would have made that payment on time in October then I would have lost that money too.

We always paid Kelly in good faith and living on Social Security it was often a struggle to do so.  In fact, we didn't even live in the trailer for 6 months after purchasing it but continued to make payments without fail.  My son was critically injured in a car accident and we stored the RV and stayed with him until he recovered.

So for Kelly to say that we were 3 months behind in payments is untrue.  The truth is.... I believe he was in financial trouble in 2009 when he sold us the RV.  That's why he was so eager to do anything to make the sale.  He wanted that cash down payment in his hand.

What he didn't tell in this story is that I asked him for the lienholders name on the evening he decided to kick me out.  I wanted to verify his story with them and see if they were willing to give me the option to finance it through them since we had been making payments for 1 1/2 years not Kelly.

Kelly Wilson lied to me about the name of the bank.  It was financed out of state through a RV finance company.  I seriously doubt Kelly sent one dime of the amount we paid him to the finance company. and I doubt he had permission from the lienholder to sell that RV to us.

If we were behind 3 consecutive payments like he claims then why didn't he follow proper legal channel to take back his property?  Like the tough Marine he is.... he chose to intimidate a 5'2" woman who's husband was critically ill.

You don't just file bankruptcy one day and hand everything over the next.  I am fortunate that he didn't get more money out of us than what he did.

You know it's always the so called, "Christians", that seem to be the worst Rip Off's.

You should do the right thing and give us back at least the $3500 down payment Kelly.

Bankruptcy must not have affected you to much. You still have a business but you left us without a home. That is.... if you were even telling the truth about filing for bankruptcy.

The story here leaves out the fact that Gary Turner & his wife were 3 months behind in their payments.  I am sorry that this couple feels so wronged, but they did not fulfill their obligations.
