In December, I was looking for ways to improve my creit rating and found out about USA Credit's Platinum Credit Card, I applied and was told there would be a $150 fee for signing up. I post-dated a check-by-phone to pay for it. I did not have enough money in my account for it on the day it was charged.

I thought it was over, as (stupid me) I did not read the terms and conditions, I was charged a $20 returned check fee. I thought this was understandable and let it be, but then this month, I saw a $9.95 monthly charge that they put on my account. My husband usually takes care of the bank accounts, so I had not seen this before, and he thought it was a bill or something I had put in.

I called them to cancel this charge, and they told me they could cancel the $9.95 charge, but then they would charge me $40 because they had tried again to take the $150 out and there was insufficiant funds, so they were charging me 2 returned check fees.

The rep on the phone said that they could get rid of the $40 by signing up for roadside service for $5 a month, so I said yes. Then I called my bank and they told me that USA credit could not charge me the second returned check fee or the $9.95. I got onto Rip-off report and looked them up (something I should have done before I even signed up), and saw that someone said to tell them you are calling the BBB.

I called and gave them the chance to get rid of the charges, and when the guy started getting rude, I brought up the BBB. He put me on hold and my phone died. I guess it was good timing, though, because they must have thought that I hung up to call the BBB, and they called me back in less than 5 minutes to tell me that I would get a refund of the $9.95, the $40 charges were taken off, and the $5 a month crap I signed up for to get rid of the $40 charges was cancelled.

I'm telling you, BBB is the plague to these people and they will do anything to keep you from calling them.

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

If the second radio station has problems with a signal, then they should get better equipment, and it is the same way with cell phones or anything else. Anyway, the terms and conditions did not say that I would be charged a second returned check fee or be signed up for a "credit check service." I did not know about the post-dated checks thing and I'll keep that in mind later. I was completely willing to pay the fee I owed, but USA Credit was trying to milk it and get all they could from me. Well-known, legitimate companies do not care if you call the BBB, because they know that they won't have any repercussions to deal with, as they are a big, respected company. It is always smaller, less-legitimate companies that care, because they very well could get shut down by these complaints, especially when it's about them taking money that they shouldn't. I understand that there might be many satisfied customers of US Online, and I am sure that if my payment had gone through and they had got money from me, then my encounter would have been much different, but since it didn't, they tried to fraudulently take whatever they thought they could get away with.

Did you not read in my post about this company that I thought a $20 returned check fee was understandable? I was willing to pay the $20 for MY mistake. They tried to withdraw the money twice and charged me 2 returned check fees. I did not say it was OK to try again, and they did anyway, and then tried to charge me $40 instead of the $20 I would be willing to pay them for the first returned check fee. Then, since I did not have the money for the credit card fee, they instead signed me up for a "credit check" service that costs $9.95 a month. I did not agree to be signed up for this service, but was signed up for it. My husband usually takes care of these things and just thought the charge was something I had signed up for. I noticed this charge and called. I was told what it was for, and said I did not sign up for it. Then I was told about the $40 returned check fees. I said that I was willing to pay $20, but I wanted the other returned check fee and the $9.95 taken off. I was told that I could have all off the fees (including the $20 I was willing to pay) taken off if I signed up for some roadside assistance junk for $5 or so a month. I said ok. Then I called my bank and explained this to them. The woman said that if I did not verify to have USA Credit try to take the money out again or sign up for the credit check services, then they could not charge me (fraudulent charges). I decided I would rather pay the $20 I really owed them, instead of $5 a month for something I would never use. I called USA Credit and told them that I wanted the $9.95 and the second returned check fee taken off, the $5 a month charge cancelled, and I would pay the first returned check fee, because that was my fault. They told me there was no way they could take the second returned check fee off. I tried to explain it to them that I had called my bank, and the woman with the bank said that everything but the first returned check fee were fraudulent charges. When I told the man on the phone this, he suddenly got very rude. I told him that if I had to pay $49.95 instead of the $20 I truly owed them, then I would call the BBB. He put me on hold and my phone died because I was waiting so long. Another man called me back and told me they would take every charge off, including the $20 I had agreed to pay, and cancel the Roadside assistance.

If anyone has EVER had a wireless/cellular phone, then you should check out the complaints about them here. MOST of the time, they are complaints about things that are contained in the "terms & conditions" of their service which they did *NOT* read when they signed up. I used to work for Cricket Communications's (you can search for their complaints on this site) Customer Service hotline. I got complaints all the time about their service, but it's interesting that people FORGET that wireless/celluar phones use *radio* frequencies to transmit voice and data (which is explained in the terms & conditions of EVERY wireless carrier). Customers complain about "dropped calls". Whenever they complain about it, I usually say "Think of it like this. Your cell phone is much like a car radio and it receives signals from raido towers. When you drive in your car, do you pick up every radio station perfectly? If not, then you cannot expect wireless/cellular service to be any different. I actually used to live across the street from 2 radio stations. One of them I picked up really strong, just about anywhere and even up to 50-75 miles from the city. The other I couldn't even pickup good until I was at least 5 miles from the station. Perfect example. Many times people blame the companies' for their billing, but many times it's the customers own fault because they didn't understand it from the beginning when they are told exactly HOW to read their bill. Sometimes, it makes me wonder "have these adults EVER paid a bill before?" You wouldn't believe how many people would complain to us about them not paying their bills in full and expecting to *not* pay for the amount they didn't pay the previous month... I really feel for you Sondra, but let that be a lesson to you: NEVER give a company a post-dated check over the phone. Federal regulations actually prohibit the giving of post-dated checks over the phone. They are processed immediately to check if funds are available.

Sondra, Think about this for a second? Would a legidiment company care if you went to the BBB? Highly doubtful. That'd merely keep your money, and let you report them. All it does is give a company a bad reputation, however, they still are around. Now, on the other hand, take for instance, companies like USA credit, Sears, Denny's, Walmart (all legit companies), they try and satisfy each and every individual customer, so mentioning the BBB isnt merely a fact that you are reporting the company, it is merely because you are a dis-satisfied customer for one reason or another. USA credit is here to help individuals re-establish, establish and/or enhance his/her credit. The company has been around for 12+ years, and has thousands of satisfied, the company will even go through lengths to make you happy, such as taking requests for new products, offering a postdating on your membership charge(s), etc. Then, not only do you get reported to the credit bureau once, but anytime you have positive activity on your account - This is to help YOU, and is a little courtesy that the company does do. Sad thing about sites like this, is that you only see the upset customers, which if you think about it there aren't many on here, compared to the thousands of members that are happy & understand what the program USA credit offers is all about. But anyway, back to the point, if you call just about any company and threaten them with the BBB, then generally you are going to have them trying to satisfy you, think about it...do companies that are million dollar corporations really want you to be unhappy? Happy customers means better business; so no company is based upon un-happy members. The only individual to blame anything on is yourself mam; you applied for the services that USA credit offers, then before balancing your checkbook, realized that you'd be over-drawn got mad - Don't blame a company that is/was trying to work with you, for your own faults. YOU are the only one that was being helped with the offer.
