This report is about an ATM dispute that turned in the favor of me the client. At the time I didn't have direct deposit with Wachovia. After attempting to fund my account manually by pulling out funds from my savings account with another financial institution, the Wachovia ATM advised me to contact my financial institution. I made two attempts to pull funds out of this ATM, the first for 300$, the second for 200$. I then had to go to my local branch and get the funds. By then the bank had closed and could not make a deposit till the following WED. (Christmas season). Unknowingly the Wachovia ATM had charged me 300$ in addition to 2.50$ out of my Savings Account. I was then told to file a ATM dispute and the money was returned to my account by the time my Savings account said it would. I notified the manager at the Wachovia Bank in Southaven MS of what occurred, he confirmed to me on the phone that once the money was found to be in fault the Overdrafts would be taken off........I knew that I had overspent my account by 89 dollars but was accessed a 35$ fee for every item that hit my account. Approximately 355$ of fees accessed. I once again asked for the fees to be taken off, I was notified by them that they could not since the "Savings" account was from Southern Security Credit Union. I made known that it was the Wachovia ATM that 'glitched' that corrupted the Savings account....I then I made a deposit to cover the pertinent negatives. A check of 100$ was then assigned 2 NSF fees of 35 dollars, making my account negative at present.... Wachovia has failed to take back fees that were caused by their ATM... They say since its a "NEW" account we can't take back the fees. You have to pay the fees. To this date I have paid 300$ with a balance of -286._-. They have taken advantage of my funds and accessed unfair charges... More importantly they have not attempted to correct the mistakes on their behalf... Something needs to be done about this issue..

but it probably would have happened at any ATM that you used. As the Wachovia employee told you, the dispute needs to be filed at your bank and they contact the bank that owns the ATM to confirm that the money was not dispensed. Then your bank can credit the money back to your account. As Melissa stated, any refund would/should be given by your bank. The bank should refund any and all fees caused by this error. What they may be saying is that the fees charged had nothing to do with this transaction.

As stated I am a former bank employee of another bank. In regards to your overdraft fees on your savings, you do have to get those refunded from the financial institution from which that account is located. They are the ones that recieved the money for the overdrafts.
