We have had an auto loan through WFS, now known as Wachovia, since July of 2005. From the very beginning, it has been a monthly battle to get them to credit payments made, (even though bank statements were provided as proof) as well as continually having to prove we have maintained our Geico insurance policy on the vehicle. In December of 2006, we were, yet again, battling with a "customer service representative" named Eric C. He would simply not accept the proof of payment from OUR OWN BANK RECORDS! He called us 'losers' ,as well as stating that if I didn't stop being 'harsh' with him, he was not only going to send over someone for the car, but to 'teach me a lesson'. I hung up on him and the next morning a 06:00 the Kia was REPOSSESSED! We, obviously, were beside ourselves and had to pay in excess of $2000.00 to "get current" and satisfy the "fee's" for the repossesion. After that Wachovia bought out WFS. I kept every single statement, as well as proof of every single payment. I thought Wachovia may be an easier company to deal with so I was happy with the transfer, however, I was sadly mistaken. Wachovia evidently decided to keep all of the previous staff of WFS, including the criminal who threatened me! Needless to say the battle lingers on and on and on. With the same caliber of people. After the repossession, I filed a complaint with my state's Attorney General, however, WFS stated and provided proof that I was less than 1 week in arrears on our payment, so they, according to the law, had the right to repossess our car. They stated that according to law, we could be ONE HOUR late on our payment, and they would have the right to repossess.
I'm now dealing with them, yet again, for the same issue. My car payment is due on the 20th of the month. Bank statements prove that my payments are on time, yet Wachovia, not only refuses to acknowledge or discuss these facts, but is now threatening us with more talk of repossession. Eric C. has yet again threatened my husband, and call him, this time, a "deadbeat" We asked them if they had recieved the bank statement faxes, and according to them, they had not. This is the most unbelievable lack of ethics I have ever witnessed. Wachovia is, according to press releases I've read, in no position to abuse consumers, yet seemingly, it is still happening on a consistant basis. I would love to speak to an Attorney regarding these issues, and also hear from others who have had to endure Wachovia abuse. I'm also filing yet another complaint with my AG's office, as well as our local BBB. Please feel free to contact me with any valid input. Thanks for letting me vent. This has truly been a consumer nightmare.
