october 29th 2009 I was shopping for some last minute halloween decorations and costume pieces we ended up in electronics and bought a 40 inch tv along with 27 other items we paid and noted the clerk forgot to charge us for the t.v. wall mount so we pointed it out and made a second transaction then pd and went to leave as we exit the front doors i am already out the first set pulling the cart with my newly acquired t.v. on top behind me. My wife followed but had bags of merchandise in her hands so I had to grab the t.v. to stop the doors i thought from pushing it off as I exit. As we head to the truck my wife starts to tell me the greeter had wanted a receipt and was actually trying to take my t.v. which was way to big for her to lift so she was just trying to pull it off and let it fall angered now but figured not worth a wasted breath to go back and tell her off and explain that she just commited attempted theft and had assaulted me as well as unlawful detainment. I am headed to my truck still and am almost 80-100 feet from the store when i hear the word someone stop him he just stole that t.v. next an employee is chasing me screaming i need a receipt for the t.v. sir i turn around and walk quickly towards him and tell him off explaining again that the t.v. is paid for and unless he is arresting me to f**k off i turn and walk away and he follows shouting at me that "we aren't letting you leave with the t.v." I turn around again and noted several people running towards us some in walmart clothing and some not I said i haven't done anything wrong he tells me I am under arrest for theft and grabbed my shirt at this point realizing I am about to be jumped I push him away and am jumped they now change the arrest to "assault". So as they have me in a (1st employee) choke hold (2nd employee)arm twisted behind my back with thumb being relocated to my wrist and the (3rd and 4th employees) taking turns pulling down on the front of my shirt in the opposing direction of the 1st employee thus causing the shirt to be cutting into the back of my neck I tell them several times to stop and call the police they refuse I ended up getting my wife to call the police to report the assault when she does she is told by the police that they are not going to attend unless a walmart employee calls my wife ends up handing our phone to a walmart manager and then when she is done with the call my wife asks her for our phone back the walmart employee snarls at my wife to shut up and back off or she will charge her with assault too. When the police show up they cuff me and search me then go talk to walmart staff and tell them that i had the receipt and the t.v. was purchased and i had no stolen merchandise. The police still arrested me and charged me with assault x1 assault while resisting a lawful arrest x2 and mischief x1 because the truck they kept slamming me into got dented from bouncing my head off it. Almost all of this is caught on tape. In court the crown originally denies the video exists after I adamantly insist that it does several times I finally say if it doesn't exist then why is it listed in the disclosure. The video footage finally shows up 2 day before I go to court again on aug 12 2010 thats 10 months and i only get 2 days to view and build a defence. Take note I am mid trial now waiting to finish (jan 14 2011). I have no lawyer because at the time of incident I was a 100,000 plus a year income (too much for legal aid) and since the incident am only a 45,000 a month income i have 5 children and cannot afford to live anymore but recently have managed to pull out of my depression and am starting to gain control of my downward spiral I have lost my home and am renting a house all of our possessions lost and my flawless credit destroyed  thankfully my wife took the time to sit me down and explain if i don't change they are leaving me...appointments with doctors and shrinks are being made. So walmart I hope you are proud of your accomplishments but rest assured I WILL seek compensation and no longer ponder suicide so this problem will not just be blown away.

I was very clear in my original post that i had bought the stuff not stole it so as the law is very clear it was my property not theirs...I was also very clear and quite frusterated at people that cannot read, I f'd them off after they assaulted me and unlawfully detained me not to mention tried to place me under arrest for theft that had not occurred.

Hi I tried to update this already but the post never showed. I am trying again. I finally got my days in court. Yes days. After a long gruelling battle to prove my innocence and show that the walmart employees had lied a judge found me not guilty. To all others out there who have travelled down this road as well my heart goes out to you. A video that proved the walmart employees were lying was hand delivered to my house 10 months after the incident. The video showed that the testimony of 4 of 7 witnesses was a lie. Testimony of one of the crown witnesses makes number 5 witness a liar. Of 7 witnesses that the crown had only 1 was honest. The judge however agreed with some of you in saying that a receipt should have been shown. The failure to show the receipt however was not legally required but morally a better choice. In better circumstances I would agree. Now that in no way allows walmart to illegally detain me or to unlawfully arrest me. What walmart is doing is wrong there are many other ways to prevent theft and to name a few how about starting with tills with individual doors you pay and exit immediately, or escorted help with larger items out the door, a membership that customers sign allowing the searches they want, cubicals with automated locks we swipe our payment and door opens releasing product only after payment is verified, or the simplest I can think of and you can thank me for this walmart a camera pointing at the tills and the customer paying that can be viewed by properly trained loss prevention at the door so they will already know the t.v. coming towards them was paid for. Now to sue for the damages, pain and suffering, stress and embarassment as well as a few other things.

I just remembered this chain of incidents that happened at the store I worked at in Auburn, WA. So we were always missing DVD's, back when they were the "in" thing.

We saw a guy in leather riding gear get off the back of a crotch rocket and walk into the store. He strolled in and grabbed a hand basket, he really did look very charming. So okay, just a random guy, no big deal. A few minutes later he comes running from the electronics section, goes past the exit greeter and hops back on the bike that his friend conveniently had waiting outside the door. We were all like "WTF just happened??!?!?!"

My point is there wasn't anything we could do. If he managed to get in the store without anyone noticing we could not chase him, we could only call the police or loss prevention. If he was noticed he ran out before taking anything, but if he got through undetected he was home free. We literally just had to watch him run out the door. Sometimes he was a smart a*s and if he knew there was no one of any authority behind him he would slow his run to a light jog....and smile. He knew his rights and our instruction to just observe.

This happened a good 10 times that we know of, I witnessed about 3 personally.

I am still new to this "rebuttal" thing so here goes.


I believe there are a couple of points in this story that simply could have been avoided. If you are walking out of a store and you have an expensive or large purchase, you should be prepared to show a receipt. I think this is just common courtesy to the exit greeter. They have no clue whether you paid for the items that were bagged and then just added a TV after the fact. Whether you think that is right or wrong, or an invasion of privacy, that's just the most logical and polite thing to do. You should have the receipt at the ready. A mistake on your part, no big deal. Now when they asked you for a receipt or started showing signs of thinking you stole it, you should have produced the paid receipt or stated, loudly if necessary, "I HAVE THE RECEIPT, JUST A MOMENT!" Problem solved....

Since this didn't happen, you claim the employees thought you were stealing from the store. I have worked for Wal-Mart and at that time became good friends with loss prevention. Now you haven't mentioned loss prevention so I assume these are just regular employees that accosted you. Wal-Mart employees are not allowed under any circumstances to touch you. Even if they see you put a TV in a cart and walk out, they cannot do anything except follow you, call the police or loss prevention. If you haven't walked out of the store their options are even more limited, since you haven't technically stolen anything. Anyways, they are taught not to subdue any person. This is unnecessary risk taken and Wal-Mart is cheap. They do not need that kind of liability nor do they want employees to scream lawsuit. They have no idea what kind of person you are, you could have been a maniac with a gun who forgot to take his medication. So for 4 employees to "attack" you like this is pretty unbelievable. I am not going to make judgment here since everybody wants to be a hero. 

I will say that if this happened to me, whether I had the money or not, I would be in the court and the media for sure. I would make it work by any means necessary, even if it meant living uncomfortable financially. Just because you were a d**k doesn't mean they have the right to treat anyone like this. Of course this is all hypothetical assuming this entire posting is an accurate portrayal of events.......

first, you should have just showed your receipt. Besides that I thought it was against the law/policy for employees to 'chase' after someone they believe has stolen something? Besides, Walmart is filled with idiots.

This whole story sounds fishy.  Get some professional help, you do have problems.

Next time show your receipt.  Stop shopping at Walmart!  They apparently don't want your business.

Telling us this story (which may or may not be true), the fact remains that if this ridiculous person had spent roughly 15 to 30 seconds showing the the receipt they would have been on their way. Sure the property is your once you buy it but you need to be able to prove it.

I have no pity for them at all, it was an obnoxious way to act and they were wrong in every way.

I expect the story was imbellished for effect also.

I follow you..to an extent. I agree that what that did was wrong, if the events are as described. But, with the information presented, you will need a lawyer.

You need credibility in order to sue a fortune 500 company. Using the "I'm mentally damaged" tactic ruins credibility.

Using the "I make more than the national average, but can't afford to live" tactic does not work either to build credibility.

I'd say the best bet would be to find a lawyer who will run with your events. Walmart typically uses parking lot cameras as well so the events were most likely documented. Sit there crying and have the lawyer work it in your favor. The use of personally damning key phrases would be harmful such as "Suicidal"... "Lost wife and kids"..."doctors and shrinks." That portrays you as the common denominator rather than Wal-Mart.

But, also discussing an open case on a public forum can also get it thrown out.

For those of you who think it is ok for walmart to act in this manner. I have been to walmart previously and bought a cart full my wife and 2 yr old went to mcdonalds after i paid i went and sat with them and decided to go get our truck and bring it up front as it was -27 degrees celsius outside with blowing snow. My wife finished lunch and was bringing our son in the cart out and got stopped  after 15 min of waiting i finally went in to find out what was taking them so long as i stepped through the the door my wife is on the ground crying as they would not let her leave, our son they had taken and would not give him back... oh guess what i had the receipt in my pocket because i had paid...so tell me again how walmart has the right to do this...the difference that time was i had no idea of our rights...what if i had left and gone home in our second vehicle? so those who think we should all just let walmart get away with this stand up please and hand over all your rights because it is you who enables these kinds of unacceptable abuses...Once i have paid it is my property! Any attempt to take my property is THEFT plain and simple so please refrain from comment if you have no idea what you are talking about.

I'm with ramrod. You should have just shown the receipt when asked and everything you went through with walmart and the courts would have been avoided. From what you wrote, you sound like a hardheaded person. You were wrong, admit it and move on. You would be a better person for it. Its destroying your life. You sound like you were doing pretty good prior to this incident so you have the capacity of getting it all back if you just "Let It Go". Think of your family. Whats worse, losing a battle with walmart or losing your family because of it? Get your priorities straight.

Why didn't you just show the greeter the receipt?

You were on Walmarts property leaving with there items, this is one of the most shop lifted stores around and they DO have the right to verify you paid, once you told them to F/O you told them something was up and had everything you got coming to you, best hope I am not on the jury as you will lose.

BTW, I hate and usually do not shop W/M but I know there policies and have seen them tackle many shoplifters.
