Our nightmare began in September 2001 when we received a letter stating that we had bounced a check. At the time we had not even sent off the payment. I disregared the letter thinking that it was a mistake. We sent off the payment for Sept 2001 and it was cashed. We then got a letter from them stating that our check had bounced and, we were also two months behind!

I immediately went to my bank and got copies of those checks that were cashed reflecting the past three months. That same day we faxed the copies to a lady by the name of Eugena. We got a call the following week asking whay we had not sent payment in the past three months.

I told this individual that I had faxed copies to them showing that payment was made. The idiot told me that we has faxed the wrong copies of checks. I told this idiot that he was wrong because Their bank had cashed those checks. I was unable to get through to this stupid individual and instead wrote a letter to their Consumer Advocate.

I again submitted copies of the checks but this time for an entire year of paymants. She wrote back stating that the problem would be resolved in 60 days. After 60 dsys she wrote again wanting a 30 day extension. I have never heard from her again. The problems continued and we submitted again proof of payments for the past two years to the same Consumer Advocate.

We continue to receive letters stating that we owe $336.00 in late fees when we don't owe anything. In October of 2002 my Husband made a payment by phone for $1,287 dollars that they said was due and stated that everything was up tp date with them. I was angry at my Husband for doing this since we were not behind on our paymants but, he told me he was sick and tired of their BS and just wanted to get them off our back. Two weeks later we received another call from them stating that we were still three months behind. With all of the money I have paid this Company it puts us two months ahead of our Mortgage payment. In the end of November 2002 we got a letter from an Attorney here in Addison, Texas stating that our Home is being Forclosed due to non-payment.

Our Home will be sold at Auction January 7th 2002 at the El Paso Courthouse. This does not include all of the problems we have had due to them not recognizing our Home Insurance that they said we did not have even after numerous faxes to them. I will not leave my home under any circumstances! Since I know I am in the right and have proof! I don't think a Judge would allow this Corupt Corporation to kick me out of my Home. I am not adding the Emotional, Mental, and Physical problems this has caused our Family because it would take me another long page. How could this happen in America?

I came from Mexico where this is very common but, I never immagined it could happen here. I curse all of them for what they are doing to us and all of the other victims of Fairbanks Capitals and their AKA's.

On 1-7-03 at 11:00am my House was Forclosed and was about to be auctioned off. Luckily our Attorney was waiting for them with a Restraining Order! They could not sell my Home. At that same time a Lawsuit was filed. I don't know how long or what exactly is going to happen. All of you that are in similar situations D0 NOT TRUST THIS COMPANY! Get an Attorney as soon as you can! Go to your Bank and get all of the copies of cancelled checks or any transactions that have been done with this Company. Write dates and calls of conversations over the phone. Save every document you have received from them as well as copies of letters you sent them. Send Certified Letters to them if you need to corespond with them. This will help you in Court. I found another Website similar to this one with another one of their AKA's www.forclosureforum.com/mb/messages/78.html. I hope this will help you. Don't give up! If one Attorney won't help you be persistant and find one that will. Good Luck to you all! Veronica
