Yes I have already done those things. NVidia is a reputable company, and most of their cards are indeed CUDA enabled and work with the Mercury Playback Engine in CS5 (my editing software is a professional grade).
I will continue to persue this matter with XFX with my lawyer. I have purchased another NVidia GTX 285 from PNY to replace the XFX card. I will also purchase the new NVidia GTX 580 to replace the GTX 285, however it will not be from XFX, more likely EVGA or PNY since they stand by their products.
I still believe that the XFX warranty should replace an NVidia card, with another NVidia card, not an ATI, and if they can't do so, issue a full refund. If I pulled a stunt like that with my customers, I'd be out of business....but companies like XFX think it's OK to rip people off because they can get away with it. XFX seems to think their policy is a good one, I disagree.

You must have already thought of this. If this specific card is so crucial to your operation you should buy one somewhere else and then continue the fight with these people and have a backup machine with the correct card. I'd also consider software that works with more than one specific card. I mean, what if the manufacturer decides to discontinue it or whatever?

The above complaint has a typo, it was in the first line, and should read as XFX card, not PNY.
PNY is a reputable company.
