I compained that they charged up front, and then my car did NOT pass, and I submitted a formal compaint to the Bureau of Automotive Repair.

You had the option to pay and get your car tested, or not pay and go to another location. You chose to pay, so you were NOT ripped off.
The fact that your car failed is not the fault of the mechanic. If you only wanted to pay if your car passed, this is something you should have brought up beforehand.
The BAR isn't doing to do a thing about this except perhaps to laugh.
