1. On or about September 26, 2023, we purchased the condominium located at 2385 North Wild Blossom Court, East Lansing, MI 48823. 2. Asa condition of purchase, Legacy, LLC (Legacy), promised to repair the rotted wood on the building's East Exterior Wall, the associated waterleak, and the resulting water damage to our recreation room/basement window frame, inner wall, and floor. 3. To date, 6 months later, despiteour continuous requests, Legacy has failed to perform the repairs. 4. Every month, we have diligently paid our condomiunium fees. 5. Instead ofperforming the contracted repairs, over the last six months, Legacy has taken actinons ti including the following a. First, Legacy denied that itpromised to make the repairs. b. Second, Legacy admitted that it was responsible for the repairs. c. Third, during repairs Legacy initiated on thecondominium building roof, Legacy damaged the ceilings of our primary and third bedrooms, the damages Legacy inflicted caused holes toappear in our ceilings. d. Fourth, after we sent Legacy photographs of the holes they caused in our bedroom ceilings, Legacy promised toperform, but never completed, repairs to the bedroom ceilings, causing us to incur out of pocket expenses in excess of $1,000.00. e. Fifth,inafter the incident with the bedroom ceilings, Legacy promised to inspect the East exterior wall, associated water leak, and the resulting waterdamage to our recreation room window frame, inner wall, and floor. f. Sixth, when asked about the schedule for completion of the promisedrepairs, even though it had never done so, Legacy claimed it had inspected the damaged areas and that it was awaiting a bid to present to theboard for repairs. g. Seventh, when we notified Legacy that it had never conducted the inspection, Legacy scheduled and conducted aninspection, promised to take bids for the repairs, and promised to submit those bids to the board. h. Eighth, over a month after Legacyconducted the inspection of the East exterior wall, associated water leak, and the resulting water damage to our recreation room window frame,inner wall, and floor, we asked Legacy for a repair schedule and Legacy claimed it was still awaiting bids. i. Ninth, afer another month passedwithout action, and we refused to pay condominium fees if Legacy did not perform the repairs, Legacy said the HOA Board approved the bid torepair the window. j. Tenth, again, a month later, even though we have paid our condominium fees, Legacy stil has failed to make any of thepromised repairs to the East exterior wall, associated water leak, and the resulting water damage to our recreation room window frame, innerwall, and floor. 6. Legacy's failure to make the promised repairs has directly and proximately caused further damage to the building's Eastexterior wall, associated water leak, and the resulting water damage to our recreation room window frame, inner wall, and floor. 7. We have exhaused all of our other available remedies. 8. Please direct Legacy to make the promised repairs to the East exterior wall, associated waterleak, and the resulting water damage to our recreation room window frame, inner wall, and floor and to deduct the costs and expenses we haveincurred for the repairs to the bedroom ceilings. 9.
