I purchased a 2015 Toyota Sienna from Best Buy Auto and Michael Alaya on April 10, 2024. It was as is and no warranty. I set up an appointment with my mechanic, where I live, as I did notice an oil leak (I was not expecting new or no issues since it was a used vehicle). My appointment with my trusted mechanic was April 29th.  

Once my mechanic was done looking at it they advised me not to drive it as it was unsafe and driving it would cause more damage as well as more costly repairs. There is a lug nut post missing off a back tire and lug nut, the differential is broken and needs to be replaced, there was a mouse nest in the engine bay area  (so I still don't know if there is any wiring damage due to said mice), the oil sticker was way out dated, so I do not know when oil or fluids have been done, front struts are bad as well. The oil leak that was first found is in the exhaust cam VVT solenoid. The two front tires are basically bald and the back two tires are mismatched (I ordered tires right away and have 4 new tires now waiting to be put on because the tire place can't put them on due to the repair issues.

I spoke to Michael Alaya this morning as I received the costs to fix these major repairs that were not disclosed before I signed purchase agreement. I stated I had contacted the Attorney General for consumer protection to see if there was anything I could do. After getting the repair costs, I contacted Michael Alaya as the Attorney General office advised. He stated that since I contacted the Attorney General he will not work with me at all and my attorney can contact his attorney and hung up on me.

 In addition to Irv's points, I would like to point out that you don't need to be a mechanic to see bald tires, outdated oil stickers and missing maintenance records, mouse nests, oil leaks, and missing lug nuts. Did you even look at this car before you bought it? Did it not occur to you that a car with a few dozen minor problems might also have a couple of major ones? And yes, an "as is" sale means just that.

You knew, because you stated it here, this was an AS IS sale. Did you even bother to READ the sales contract BEFORE you agreed to its terms??? Did you even bother to read if any BOGUS, FAKE FEES were added like Dealer Fee, Electronic Filing Fee, Processing Fee, Documentation Fee??? The most hilarious part of all is you had this mechanic you knew. Do you kind of think the COMMON SENSE thing to do was to have him check out the car BEFORE you bought it and not after??. Don't bother writing back something equally stupid like "you must work for them". I don't! You bought this thing AS IS and you have no recourse! NO RIP OFF HERE. Buyer has no clue what AS IS means and failed to use common. sense to have the mechanic check out the car before purchase instead of afterward!
