On April 15, 2021 I purchased a lazy boy maverick 38 wide leather recliner from Wayfair order number 3560684035. On our approximately May 20, someone sit down in my chair and scratched the side of it, during my purchase from Wayfare I purchased a insurance policy, five year protection, which according to the advertisement covered damage due to accidents. The same day that I noticed it, which was approximately May 21 I notified Square trade, A Allstate company, and filed a claim online, the following Monday may 24 I checked the find out status, I was notified that I would need to speak with a specialist. On Tuesday, May 24 at 9 AM, I called the one 800 number listed, 1 - 877 - warranty, and was notified that the warranty did not cover search because it was cosmetic.

The point here it was damage caused by an accident not cosmetic, however they told me that was my problem. So I highly advise everyone to be very careful when buying anything from Wayfair, especially in regards to a Square trade insurance policies, which is truly sold by Allstate, because there is no way that they are going to stand behind anything that they sell in these policies. After doing research I found that one out of 100 ever file claims, so they are a bad deal not only because of Allstate does not stand behind them, but in most likely hold you will not use them. They are truly a total rip off…….

Hard to believe that rebuttal above was from Afghanistan?

It is obvious that the rebuttal that is above, is from a member of the company.  

here's my thoughts

When a individual is purchasing insurance from square trade - Allstate, and is doing so through talking to a customer representative, they are not given the small print of a policy. They can only go on with what the representative had to say. In addition, it is the responsibility, Not only of the vendor of the policy, but also that of the originator, to guarantee ethical conduct when selling such policies to consumers.

I am sure that I am not the only one who never received any information concerning this policybefor sell, It may have been that the operator, typed my email incorrectly, or not at all? Regardless before sell, a statement needs to be read to the consumer so that I may be aware of all the small print and conditions that are contained within the policy.

I have filed a complaint with the proper  authorities, and I hope to see more individuals who have been missed lead concerning these types of protection policies follow suit.

Hopefully in the future, we will see more regulations, and even possibly the outlawing, and criminal penalties, for those who  use misleading information to sell these type of products to the public and consumers.

Next time, try reading the policy prior to purchasing it.  Here's the cosmetic damage exclusion in your contract:

(A) Except as otherwise provided, normal wear and tear;

[...]

(P) Except as otherwise provided, “cosmetic damage,” defined as any damages or changes

to the physical appearance of a Product that does not impede or hinder its normal

operating function as determined by Us, such as scratches, abrasions, peelings, dents,

kinks, changes in color, texture, or finish or similar conditions;

Your policy also pretty clearly excludes:

(A) Products made of “X” coded fabric, dry cleaning only fabric, non-colorfast fabric or silk

fabric;

(B) Natural flaws, inherent design defects or manufacturer’s defects, including, but not

limited to, natural inconsistencies in wood grains, fabrics, coloring or leathers; wood

stains; delamination of microfiber; manufacturer’s defects of leather or upholstery;

(C) Stains caused by from incontinence, hair and body oils, perspiration, paints, dyes,

bleaches, flooding, rust, fire (including cigarette burns), smoke or other caustic materials as determined by Us;

(D) Damage caused the application of topical treatments to the Product;

(E) Damage to the Product caused by gum, mold or mildew, fading, color loss, non-stain

related discoloration, dust corrosion or similar;

(F) Odors, pet or animal damage from teeth, beaks or claws;

(G) Splitting, cracking and/or peeling of A&P leather, bonded leather, bycast leather or

coated fabrics;

(H) Scratches of any type;

(I) Loss of resiliency;

(J) Separation of seams along mattress seam lines.

So it's pretty obvious your warranty does not cover this type of damage.  In addition to being cosmetic, it's also exlcuded under at least 3 other provisions (normal wear and tear, scratches, and peeling of leather).  In fact, this warranty wouldn't cover your item even if all the leather completely peeled off.
