Bank's stated event:

The attached letter was mailed to the consumer. No follow up actions are anticipated. The letter states as follows: Thank you for forwarding your concerns regarding your recent experience with TD Bank (the "Bank"). I'm writing today to let you know we are in receipt of the complaint you filed with the Consumer Financial Protection Bureau ("CFPB"). We certainly regret any missed opportunity to deliver outstanding Customer Service we expect from our team. In your complaint, you allege your Account was compromised, you completed a Fraud Case as well as filed a police report. However, the Account is reflecting a negative balance of $3,856.60 and is being handled by the Bank's Collection Department. A new Account was opened and $216.88 was transferred from the Account and you would like to dispute this transaction. In researching your concerns, in October 2022 there were multiple mobile deposits made: Deposit Date Amount October 7, 2022 $4,500.00 October 11, 2022 $4,000.00 October 11, 2022 $4,500.00 October 13, 2022 $4,500.00 The mobile deposits were returned due to altered/fictitious checks. On October 20, 2022, you called to report fraud on the Account. You confirmed that you were applying for a job and your online banking information was provided and deposits were made into your Account. You updated your online banking information with our agent when you called to report fraud. Your Account was frozen for 30 days. You were advised the Account would need to be closed and a new one opened. A new Account ending in 5681 was opened on October 28, 2022. On November 20, 2022, the case was closed. The Fraud claim was found to be unsubstantiated since you confirmed you provided your personal banking information. Due to the returned deposits, the Account went into the negative on October 18, 2022. To mitigate the outstanding balance an offset was performed on December 14, 2022, in the amount of $216.88, once an offset has been completed, it cannot be reversed. In the Personal Deposit Account Agreement, Section "Right of Set-Off" the Bank outlines our ability to set-off any accounts you hold with the Bank. The agreement specifically states "Unless we are prohibited by applicable law, the Bank can take funds in any of your Account(s) to pay any debt you owe us that is in default. This applies to all funds of yours in our possession now or in the future. The current balance owed on the Account is $3,639.72. It is my hope that this letter helps to address your stated concerns. My stated events:

 

Checking Deposits: Date Amount: October 7, 2022 $4,500.00, October 11, 2022 $4,000.00, October 11, 2022 $4,500.00, October 13, 2022 $4,500.00. The mobile deposits were returned due to altered/fictitious checks.

TD Bank off set my bank account for $625.77 and $216.68. I filled out a Affidavit of Forgery: Counterfeit Checks on 12/2022 for the Checking Deposits: Date Amount: October 7, 2022 $4,500.00, October 11, 2022 $4,000.00, October 11, 2022 $4,500.00, October 13, 2022 $4,500.00 and Td Bank investigated the Counterfeit Checks up to 90 days from 12/11/22, but no investigation result as of now 3/11/23. I contacted Asmat Bajwa at TD Bank and  Erilyn A. Pena Marty at TD Bank but no response.

I filed a police report and FTC Identity Theft report but TD Bank still refusing to refund my money and should get an apology.
