To Whom It May Concern:

My name is Anthony Dicus, and I am an AFAA & 24hourfitness certified instructor (so they say).

I seen at the Laguna club an advertisement for the Instructor Search where I was encouraged to attend by Lisa Togioka. Lisa and I met again at the Group X Instructor training last year (main inhouse training prior to other format training a few months later).

She had promised all the students there, who paid a great deal of money, that she would hire each and every one of us, and encouraged us to sign up for all the classes available in the upcoming months for additional certifications to make us more marketable within the company, as most of us did.

There is another student I met there who went through the same ordeal as I, but spent a little more than I did, unfortunately. I have her information as well for a possible class action suit?

A few months later I advanced my career by attending the 24 Hour Group Xpedition late 2006 workshop where I participated in various class formats and spent a lot of money as well.

Again, we were promised to be hired and have the opportunity to use these new formats that 24 would offer to their members!

To date I have filled out 3 applications, I have done 3 background checks. I have turned in my certifications several times. Paperwork mysteriously gets lost; I am constantly fed some sort of excuse. I've been in good spirits till now and constantly kept Lisa updated with my availability to teach.

At this point I feel brushed off, and disregarded. I've been OVERLY patient, and been a good sport up till now. Keep in mind that I was told by Lisa T. that certain classes would be given to me. It is now November of 2007 and I am still not an employee of 24.

Unknowingly, I had been an active employee 3 months prior, to August of 2006 with no prior knowledge. I had only discovered this new information from a letter sent to me from corporate during that time.

It was expressed by Lisa T. that the system has terminated me. Yet, I received a benefit packet in the mail that same week after Lisa said the system terminated me.

Lisa had never informed me of my status, regardless of my constant efforts in contacting her. Alondra (current emloyee of 24) spoke with Lisa, (not knowing she planned all along to terminate me with no reason or cause) and asked Lisa why I couldn't teach any classes.

Alondra followed up with Lisa, and was told that she (Lisa) hadn't terminated me yet, and had planned to. Im certified through 24hourfitness to teach their various classes as promised only to get terminated without even starting.

Keep in mind we were told to sign up only through Lisa Togioka so we could get a discount (bigger bonus check for her apparently).

Why wasn't I informed that I was hired on since August of 2006? Why did she wait 2.5 months later to call me in after August? Why am I being lied to? Lisa Togiokas unprofessional administrative dishonesty is clear. Lisa's empty pledges, the need of instructors shows to be just a game with intent of financial gain of victims truly interested in becoming an instructor.

We are now in 2007. I've seen unsatisfactory demeanor, spent a great deal of money, and was sold a product that was never delivered. I believe this is a case of fraud and would like to take action.
