I worked for this company for 3 weeks, and while there I detailed and corrected the paint of 13 vehicles and also performed mechanical work for them. I logged 136 hours in 3 weeks of employment between 3/27/2017 and 4/14/2017 no pay now my bills are behind. They are claiming that they do not have to pay even Washington state, or Federal minimum wage. I have given Al, and Derek Tall plenty of chances to make things right, yet they fail to. I have sent my information to L&I for them to handle and hope they can. They are liars, crooks, and con artists. They used to own Blue Mountain INC back in 2013 which is also on Ripoff report for another issue regarding ways to line their pockets. I also have proof that they were working without a business license, and Derek was working on vehicles when he was not supposed to because of a prior on the job injury at an auto dealership he worked at in Moses Lake. I hope his current detailer he has hired doesn't have to go through the same hell as me. I know never to work for a "friend" again.

Set The Record Straight

There are some things I would like to clear up. I should have done my research about the accusations I made.

  1. The Blue Mountain claim. I found that Derek was only an employee of that company and he had nothing to do with what happened. Al was not connected either.

Neither Derek or Al have ever been associated with “Blue Mountain Inc”. There are many companies with Blue Mountain in their name. Derek was an employee of a company with Blue Mountain in its name but was never connected with the company “Blue Mountain Inc”.

2. Derek working while he was not supposed to. I misunderstood that scenario, and he clearly is able to work otherwise he wouldn't have opened A Cut Above

3. Business License. I was shown proof of the business license, and they are clearly legal to do business in Walla Walla.

So to sum things up, I should not made unfounded accusations. I had agreed to certain compensation plan and then I decided I wanted to change it. It was this change that created the dispute but we have resolved our differences. Neither Derek or Al are crooks, con artists, or liars. We have settled our difference and wish each other the best in the future.

 Jesse time cards are provided as required by state law, everyone else can fill them out. I however am required by state law to keep a second copy just for cases like this. Jesse breaching customer privacy is a serious issue, you calling customers and lying about things such as my business license is slanderous. A simple state of WA corp check shows our business license is just fine. I have been working with the state and provided them copies of everything they have asked for and yes your time cards are in there. I have not bad mouthed you yet you run around talking nonsense to anyone that will listen. I have refrained from filing a police report over the missing chemicals. Lets work with the state and you will be paid what they deem you are owed. Fair enough?

 Okay, yes I filed as anonymous for my own reasons. My name is Jesse Smith. I Live in Richland Washington, and commuted to Walla Walla washington to A Cut Above from the dates of 3/27 to 4/14. I was an employee here during those 3 weeks.15 working days not including a weekend which I worked. And with the weekend days I worked, yes my 136 hours are accurate. However being that Derek never actually provided time sheets, let alone any for me to review and sign after the work week. I was never provided a w4, or any other employment paperwork after asking several times for them. As far as the other issues that are mentioned, those are not the issue at hand, the issue is that I did work for A Cut Above for the length of time previously mentioned, and have still not received pay three weeks after my last day. Which is certainly not in accordance with Washington state law.

  While Jesse Smith did work for us for 9 days it's hardly considered 136 hours. Durning this 9 days Jesse worked on his personal cars using company chemicals and equipment with out paying for these. Per WA state licensing we are licensed, not sure where he got that from. He did need a fire dept inspection that was completed last month, yes it was my fault for not getting it done sooner but I was inside the time allowed. There is a reason he filed this anonymous, I have nothing to hide. There was not 13 cars done there was 6-8 and of those he damaged 2 that I had to have repaired. Again I don't hide from it. As for the L&I claim that's pretty much a made up lie! I was injured in Oct of last year, L&I called me today in fact to do a check up on my case.... kinda hard to claim I'm not working when I am. Oh Jesse as per state law I did in fact keep daily time card on you, it was 9 days. I sent copies to L&I in response to your claim. Ahh your Blue Mountain claim, I was an employee of that company. That's it, you failed to mention that the complaint was filed after he was arrested for insurance fraud! You knew that. You claim friendship, you called in 9 days of work later and said you had a huge tax bill and needed time off. You never returned and I had to work non stop late into the night to get people cars to them on time because I gave them my word. I keep my word, as I stated and you refused the pay for 9 days. Your check is still sitting at the office, you refused to fill out an employee info sheet so I don't even have your address. Sooo this is where is gets interesting that you didn't share this is you would only come back is I paid you $50,000 a year. Not what we agreed to so you left and now want to drag me through the mud. Your check is here for 9 days that you worked. If you have signed time cards then show them and I will pay you as I stated.
