I got a call from a Henry Jay on September 28th, 2005 and he stated that I had a payday loan out with a company that I had never heard of and he told me that if I didn't pay $850 by September 30th, 2005 that he would send someone to my job with an arrest warrant and I would go to jail for bounced check charges. I don't understand.

I actually worked for a collection agency in the sales dept, so I wasn't one of the a-holes calling people about collecting. Anyway, if they did tell you that, you can sue them for threatining you with imprisonment for not paying a debt. $11,000 per offense. Check it out. Send a letter letting them know you have full intent of suing them for the $11,000 for violating collection laws. 9 times out of 10 they will settle with you and 99% of agencies have ALL phone calls recorded.

You can FIle not only with the AG but make them go to Federal Pen too. Its not only agaisnt the law but was done over a telephone which makes it a Interstate Crime punisable and also under the telecommunciations act,FCC, too that you can put them BEHIND BARS MARK

First of all, they have to give you something in writing, giving you a chance to dispute the "debt". After you request validation (proof of) the debt, they have to either provide proof (and a printout from their database is not proof..something with YOUR signature is, such as a copy of the check you allegedly bounced). They have already violated the FDCPA by threatening you with arrest, as this is an action that they cannot take. Please go to the budhibbs.com site. He is in the Houston area and may have some information on these people. There is also a good "cease and desist" letter on there that you can use and send to these people, so they will stop calling you. Don't stress out over these cretins. They make their money by scaring people with threats of actions they have no legal authority to do.

You need to contact the Colorado AG's office and file a complaint and the Federal Trade Commission and file a complaint. If you could not tape the call, make sure you write down the date and time of the call and what this person said to you. Keep a copy of the information on hand in case he calls again. He can't throw you in jail for anything. It was a scare tactic. He was hoping you'd drop everything and pay...then HE gets a commission.
