Admiral Enterprise, Backyard Paradise Pools & Spas, American Kinetics Ripoff! Doesn't honor warranty, trys to avoid having the case settled, & then refuses to pay. Bear Delaware
I had a fiberglass in ground pool installed in the summer of 2002. There were numerous problems with this pool. Admiral Enterprise broke many promises over 6 weeks to make repairs. They even lied to the BBB about their intention to make repairs.
We filed in small claims court, which according to our contract and the American Arbitration Association rules was our right. The owner lied in court and said we had to go through binding arbitration. This was not true, but the Judge forced us to do so.
We won an award via arbitration, and the owner had the nerve to stand in court and state he still had the option to go through court. This was just to delay having this case decided once and for all. The Judge fell for it, and we had to get a higher court to intercede.
We now have our judgment, but are not receiving payment. We had a sheriff sale in September, and purchased $5k of merchandise for $21! The owner was not on site, but he did call the police to have my husband arrested for causing physical violence. This was a total fabrication. Luckily the sheriff's office personnel were able to speak with the police and verify that they were present the entire time, and that my husband conducted himself in a peaceful and lawful manner. (This is just one example of their outrageous behavior & lies.)
We have another sheriff sale on Friday, December 19th 2003, at 9 A.M. The sheriff's office has put the entire contents of the store up for sale. This is because the saw $5k or merchandise sell for $21 at the last sale, so they know at this rate we would never get our money back.
The sale will consist of pools, pool chemicals, pool toys, office equipment, a computer, file cabinets, bulletin boards, desks, chairs, pool filters, spa filters, refrigerator, and a jacuzzi.
There is a lot more to this story. DO NOT DO BUSINESS WITH THIS COMPANY. They do not honor their warranty, they do a shoddy job, and they know how to manipulate the system to try to avoid having a case decided. When we went through arbitration all evidence was to be shared, they submitted evidence I never got to see until AFTER the arbitrator found in my favor. A lot of evidence they submitted were lies, and yet I still won! Now they are doing everything they can to avoid paying this debt they owe.
