I hope you can help me with a problem i am having with a debt collection agency called AFNI they are located at 404 Brock Drive Bloomington, IL 61702.

The problem started months back when i was notified that i was turned down for a credit card that i had applied for due to an adverse account on my credit report.

I have always had excellent credit and paid all my bills on time so i was totally confused when i got the letter.

I then went to Transunion and pulled my yearly report and sure enough there was a adverse account for $191.00 for a company called Charter Communications that AFNI was trying to recover.

First, i have never heard of Charter Communications, i have lived in Chas. county since 1980 and have never heard of this company in this area. Also the name on the bill was for someone with the same first name as mine but a different last name, who i have never heard of, and was for service to a city, which i have never heard of either, or have ever been to or lived.

Next i called AFNI, got the run around, asked me alot of personal questions such as address, SS number, which i know now, i should have not answered, but i thought they were being helpful and were going to try to help me get this taken care of.

Then i start getting mail to my address for Christine Smith.

I have repeatedly called AFNI and stated my claim that i am not said party and do not owe Charter Communications any money.

I have told them this is a case of identify theft and fraud.

Next, i contacted the 3 CRA's and disputed the charge with them.

Then i sent certified letter to AFNI asking them to validate the claim.

Send email to BBB of Illinois, and the Attorney Generals office of Illinois and the FTC.

They say the claim is verified and i am responsible.

AFNI has ruined my credit.

What do i do next?

You've done all the right things here....This is a bad situation. As a last step prior to seeking an attorney...I would send another set of Registered Letters with Return Receipt to the credit bureaus with a note stating: "This verification of the alledged debt is incorrect. This erroneous notation is needlessly damaging my credit and I intend to take action under the Fair Credit Reporting Act. I am requesting all writing communication between AFNI and your firm which led to the verification of this alleged debt. Please provide copies of signed loan applications and a detailed billing summary for this alleged debt. If the response to this request is a form letter stating that this request is "frivolous," this letter will be documented as a refusal to provide documentary evidence of this alleged debt and I will take further action per my rights under the Fair Credit Reporting Act." ==================== If this doesn't work, it's time to see an attorney who specializes in Fair Credit Reporting Act violations.
