I'll just like to point out a few facts relating to this saga.

Two other witnesses and I did not see any damage underneath the vehicle or on the rims and on the bumper and the engine cover when it was being loaded on the Tow Truck, neither did the Tow Truck driver. We could have seen these damages when the vehicle was being loaded onto the Tow Truck and I would have definitely submitted a claim for such damages if I had noticed.

The Tow Truck driver wrote that the cause of the break-down was COMPUTER, it is stated as such in the check-list form, in his own hand writing. The Tow Truck driver could not fill in the section on ADOMETER READING in my vehicle on his check-list form, as is required, for the simple reason that all the dash-board instrument lights were off because the computer had crashed.

He was able to write down the Tow Truck adometer reading, as is required. However, on 12 September 2008 Mr Mdletshe wrote Currently your vehicle has around 35 694km on the clock The big question is how were they able to get the adometer reading unless they had fixed the on-board computer and the second big question is after they had fixed the on-board computer did the engine start?

If the vehicle was not drivable when it arrived at Volvo West Rand it means they could not do anything to it, why are they charging me R4606.74 (no invoice) as per Jacob Masemola-Mokiti's allegation in one of his e-mails above The vehicle would not have been drivable diagnostics after it was towed to Volvo and hence the Insurers are questioning the damage to the Mags and underneath. The damage to the Mags is very visible and would have occurred when the vehicle was in a drivable condition. The damage as per the accident reported to us cannot be authorized yet until the issue surrounding the mechanical damage is resolved

On 20 August 2008 Volvo West Rand sent me a quotation. On that quotation there is no mention or prices quoted for repairs considered necessary on R/F wheel, R/R wheel Front, bumper bottom section and the engine cover. The insurer later told me on 12 September 2008 (23 days later) that Additional damages were also picked up with impact damage i.e R/F wheel, R/R wheel, Front bumper bottom. On the quotation sent to me on 20 August they clearly say that the engine needed to be replaced, surely these additional damages would have been noticed when the quotation was prepared.

According to the Alexander Forbes Insurance The assessor eventually on the 25/08/2008 visited Volvo West Rand where it came to our attention that there is a serious mechanical problem with the vehicle I had already forwarded the quotation to them on 20 August 2008 and the quotation does not mention these additional damages.

I was only informed by Volvo South Africa on 12 September 2008 that Our Technical Manager inspected your vehicle and confirmed that the damage was caused by some kind of impact to the engine. Therefore it is not conceivable that this vehicle could have travelled any substantial distance after such damage but I had already received the quotation from Volvo West Rand on 20 August 2008 and submitted it to Alexander Forbes. How was it possible for Volvo West Rand to prepare a quotation before the expert assessor inspected the vehicle 23 days later.

I have been paying very expensive insurance premiums to Alexander Forbes for the last two and half years and feel really hard done and ripped-off by both McCarthy Volvo, Volvo South Africa and Alexander Forbes. I'm not a reckless or a negligent driver at all. I've been driving for more than 30 years and I've never had an accident before. The accident on the 03 August 2008 was my first ever. The driver of the other vehicle accepted that he was wrong and agreed to pay for the damages to my vehicle. The treatment I received is both unfair and unnecessary

Currently the vehicle is still at Volvo West Rand. The insurance company provided a rental car for me for 30 days but has since withdrawn this service and I had to return the rental car. Right now I have no vehicle and I'm still paying the installment and insurance premiums (more than R9,000.00). I now have to pay for a rental every month. In order perform optimally in my job I need a vehicle. I don't have R4606.74 to pay Volvo West Rand and I really don't understand why I have to pay this amount for diagnostics. They claim that the vehicle was not drivable so why do diagnostics.

I really need help on this one, otherwise this is going to a bleak Christmas for me and my family.
