I purchased a used but advertised as "Like New" Jeep

1995 Low miles Grand Cherokee-Limited Edition on 06/08/03

for $10,997.88 to be financed at 12.99%. 59 payments of

$250.17 with a down payment of $1,500.00 and a one year

extended warranty service contract for $999.00 for a total sale price of $16,510.20

Mileage read 88,027 on the odometer on the day we drove it out of the dealers carlot. It broke down on 07-26-03 with the mileage now reading on the odometer of 90,248 miles. In the process of it breaking down it darn near killed my wife and I on highway 41 between Avenal and Kettleman City Ca.

The gas pedal,(accellerator) pulled to the floor board suddenly and I tried to release it with my foot to no avail. It picked up speed quite rapidly as we had just decended from the mountain range and were now on the straightaway coming home to Fresno from San Luis Obispo. I had to stand hard on the break and pull over to the shoulder and put it in nuetral and had to

crawl to the floorboard and finally release the gas pedal with my hands. My wife about had a Heart attack in the few minutes that this episode took place. The engine died at this point and did not want to start after that.

I had to call my towing service and they towed us home since it was too late on a sunday to have it towed to a service garage. The next day I had it towed again to where I bought it at Alpha Motors and asked them,(Jay Gill) the owner to find out what happened and to do whatever was necessary to fix it. I explained what had happened and he said it was best to take it to the Jeep Dealership since his mechanics and maintenance personal were not qualified to make a determination as to the problem. I had it towed again to the Jeep dealer in Fresno to check it out. I agreed to aninspection charge of $90.00 as I figured the warranty would cover all costs except the $100.00 deductible I had on my service contract.

Well that inspection charge soon doubled as the dealership told that they had to take the engine apart further to be able to make a determination of the problem. They could not tell me what happened without further inspections and added costs. It eventually ballooned to $450.00 and the told me it would be needing a new engine without telling me what exactly was wrong with and what except to say that the engine "locked up". They gave me an estimate of $6000.00 to repair it and I said no way. All this time I had contacted the warranty company on my contract and I had daily contact with Alpha Motors that they were responsible for getting this vehicle repaired and returned to me in good working order to my satisfaction.

Well the bottom line is the warranty company AUL Administrators sent an adjuster to Jeep and had him evaluate the vehicle and make a determination as to what their responsibility would be about the situation. They determined that because of lack of proper maintenance that they were not going to cover this cliam. I have my records of taking the jeep for service to include inspections and an oil change and lubrication and the all that I needed to assure me that the Jeep would be dependable to take on out of town trips as Alpha Motors guaranteed me that it was very capable of doing, which turned to be wrong.

I tried to communicate with the warranty company and requested copies of the reports that their adjuster had taken and they refused to talk to me or comply in any manner professional or personally to try to accomadate my complaint. Alpha Motors has also not done enough in my opinion to help me resolve this problem I am now stuck with having to look at this Jeep that is parked in my driveway, broken, needing an engine and I am paying monthly payments and insurance for nothing but to wonder what I am going to do with this lemon of a car and no one wanting to help in getting back at these people who ripped me off.

I have documented conversations with names ans dates of all involved and I am the end of my wits to settle this manner in a professional or gentlemanly manner.

Your beef is with Alpha Motors first and the Jeep dealer second. Alpha Motors should take responsiblity for selling a vehicle that had problems prior to you buying it and the Jeep dealer should be ashamed of themselves for trying to sell an engine job for $6000.00. You could replace the engine with a used one for about $2500 to $3000. The warranty company is not at fault for the dealer selling you a lemon. You sould sue Alpha Motors and in the mean while find an local independent shop to replace your engine at a reasonable cost. Small claims court may determine that Alpha Motors is responsible and could get reimbursed for you expense.
