I purchased 3 DVD sets "The Saint" editions 1, 2 and 3 through amazon marketplace from DVD's 123 on Nov. 17, 2003.

As the merchandise did not arrive until December 31, 2003, I inquired several times by email at DVD's 123 and received some poor information from "Liza", stating that the merchandise has been shipped Nov. 19, 2003 and it should be arriving at my home any day now.

They repeated that statement but nothing has arrived here. I asked them to track the shipment and give me any proof (receipts from transportation company etc.) of the shipment. I did not receive any response to this inquiry.

Then I announced to DVD's 123 a deadline on Feb. 20, 2004, to either receive my ordered and paid merchandise or to be granted an immediate full refund. Since that time I have not received any reaction to further emails which I sent in order to demand a refund.

On March 7, 2004, I contacted the customer service of amazon, as they provide the market place for many dealers. They wrote me that they cannot do anything for me as their guarantee policies only cover any refunds within 60 days of purchase. The delivery estimate on the order summary

is Dec 18, 2003 to Jan 16, 2004. As I ordered on Nov. 17, 2003, the maximum time of the delivery estimate is exactly 60 days after order date.

The normal reaction of customers, awaiting their merchandise, is to complain about non-delivery

of goods after the delivery estimate has elapsed.

But at that moment, the 60 days guarantee of amazon does not apply anymore and therefore

they don't feel liable or responsable for any customer complaints or concerns.

I sincerely believe that this a way to mislead customers in order to prevent from applying for customer services within the legal consumer interest and treat this definitely as fraudulent behaviour.

However, DVD's 123 company refused to reply to my emails after I demanded the full refund.

In my opinion, the behaviour of this company has to be investigated regarding the facts of the case as consumer fraud.

In my oppinion it is strange and I wonder if it is legal that this company does not give any information

on their internet site regarding names of persons in charge, phone numbers, FAX numbers etc..

Probabely this a way to erect obstacles in case customers have a complaint or other reasons to negotiate with the staff.

I have reported this case of fraud today to

the attorney general of Minnesota, Mr. Mike Hatch, in order to investigate and to reimburse my money from these jerks.
