I agree with those that say a lawsuit should be brought against ASC for unlawful practices.  I don't know how a business can get away with the unlawful acts that ASC is pulling.  They seem to get a "high" for all the turmoil they are putting hard working people in. 

Currently I am in foreclosure because I approached ASC to do a loan mod when my ARM increased several times in a short period of time.  I was given the runaround and months went by.  I was not given a loan mod but my interest rate was reduced less than 1%. 

I then contacted a mortgage company in Portland, OR, Mortgage Express.  Stay away from this company.  I believe they were in cahoots with the scam artist, Rich Diaz of Samaritan Financial, that they referred me to. 

I was instructed by Mr. Diaz not to pay the mortgage while the loan mod was in the works.  I also paid him $2500 upfront.  Big Mistake.  Currently he is being investigated by the Attorney General's Office but I am out a lot of money.

ASC then put me on a forbearance agreement for 5 months.  I complied and even paid a little extra to show good faith.  I was told that at the end of the forbearance period I would go into a loan mod review and was told that there were several mod options available and I would fall into one.

I was denied two days before Thanksgiving and told I was in active foreclosure.  In fact, the ASC rep laughed at me when I called in distress and told me "just face it lady, we are going to take your home."

None of this would have happened if ASC had agreed to work with me when I first contacted them about a loan mod.  I do believe ASC enjoys putting people in foreclosure rather than working out a solution.  I was also informed that they chose not to participate in Obama's Affordable Home Loan Mod.  Again, they do not want to work with people.

ASC needs to be held accountable.  They are jerking people around and playing with people's livelihood.

I dont think he was being mean...........just common sense. No payment equals no house. The mortgage company  does  not care what the reason is. If you do not make the payments they are going to take the house in the end. I am sorry you are going thru this and I hope things get better for you.

You don't know the whole story so I would not judge when you don't know exactly what happened.  THere were many things leading up to me NOT paying the mortgage.  I am sure you have done things and then when you knew more have regretted your actions. 

Don't judge unless yee be judged.  America's Servicing Co. is a total ripoff and they enjoy putting people's lives in jeopardy.

You should have started the new year by saying something positive instead of criticizing someone you don't even know.  It is NOT too late to make a resolution to not judge or criticize without knowing the full details.

so let me get this straight, a 3rd party person told you NOT to pay your morgage on your home, and you followed this , now your in forclosure and complain ing about it?

First off I'm sorry to hear about your situation. But you have to keep fighting back. First file a complaint with the Federal Trade Commission,  BBB, Department of Finance in your state. Then ask ASC for the following: a audit on your account, a statement of payment history, escrow statement and ask if they have a copy of the "Power of Sale". Then find out if your state is a Non-Judicial or a Judicial state for foreclosures. They got this far because they are not a Federal Deposit Insurance Corporation they are a National Association (the right to be a bank) more or less they are not Federal Insured. I hope this helps. But just remember if you do end up in court over this ASK FOR THE ORIGINAL LOAN DOCUMENTS... Just to cover all your ends.
