I purchased a 2002 Chevy Tahoe from Gunn Chevrolet, here in San Antonio in May of 2002. The Finance company they set me up with was AmeriCredit, located an Arlington, TX.

Like everybody else in the world, I made my payment (granted, not always on time) and ran into occasional problems with them. (ie..not crediting my account, taking two payments instead of one, crediting my payment to someone else's account, the list goes on and on) Regardless, I continued to make my payments. On July 16th of this year, I went to their website to get a payoff quote. (please note: on their website it clearly states that the payoff quote includes principal, interest, late fees and any additional charges to the account) According to the website my payoff was $3496.54. Just to make sure, I called AmeriCredit and talked to a CSR, who also told me that my payoff quote was $3496.54.

That day I sent AmeriCredit a cashiers check for $3496.54 via UPS overnight. I tracked it online and saw they had received it on July 17th. I waited two days (July 19th) and called AmeriCredit to verify that they had received it and credited it to my account. The CSR I spoke to said they had indeed received it, and had credited it to my account. At that time she told me that my balance was $0.00 and I should receive my title in 30 days.

After 40 days, I still hadn't received my title. So, I called AmeriCredit to inquire. When I called, the automated answering came on and asked me to enter the last four digits of my SSN. So I did. The automated voice came back and said.this account is paid in full, to inquire about receiving your title, pleas press Zero. So I did.

A CSR came on the line and I inquired about my title. She proceeds to tell me that on July 19th, there was a fee assessed of $633.56 and I would not receive my title until that amount was paid. Needless to say, I was completely shocked. How could they assess charges AFTER my account was paid? According to them, it was a returned check from the payment I made in June. When I assured them that I never sent them a check for $633.56 in June (and they agreed) it was settled. So again, I was waiting for my title.

On September 15th, I received a letter from them (which they dated July 28th) that stated that recently receive my payment which satisfied the principal and/or interest balance on the account; however, there were outstanding late fees on the account in the amount of $633.56 and they were holding my title until this amount was paid. ( I received a second letter on September 18th stating that this was my final notice)

At that time, I called AmeriCredit back and spoke to yet another CSR and informed them that I had receive this letter and that I wanted a full payment history on my account.

On October 3rd I received the payment history. It was printed on September 26th, and clearly shows that there was no activity on the account after July 17th when the last payment was made. It also shows that as of September 26th, my balance was $0.00.

If I owed them $633.56, why were there no phone calls to me? Why no statement sent? Normally, when I was THREE days late with a payment, they were calling my cell phone, my husband, my work and my home phone at least four times a day. Now supposedly I have owed them money for almost three months and no phone call whatsoever.

I went on the internet to look up other complaints. It appears that AmeriCredit makes a habit out of losing titles, not releasing titles, unjustified repossessions, and a lot more. I think it is ridiculous that this company is allowed to continue to operate, especially now when people are working so hard to pay their bills and do the right thing, when our economy is going to hell. Its companies like these that take advantage of people.

I am sure that AmeriCredit thinks that I will just let it go and pay this trumped up charge of late fees just so I can get my title, but I won't. I have documentation on their own letterhead stating that I owe them nothing. So, why are they allowed to arbitrarily add charges to my account and hold on to MY title until they are paid.
