On Feb 1, 2009 I ordered a Trial Offer of Acai Berry that Oprah & Rachel Ray are just nuts about. I LOVE & TRUST both of them and have purchased many products that they have endorsed. I authorized the $4.99 for the trial offer & received the product a few days later. On 2-19-2009 one morning before work, I went on line to check my bank account and there was a debt $79.96 & it also said that it was PRE-AUTHORIZED WWW.NATURES-ACAI.COM Reno,NV.

I went back through all my paperwork that I had copied every page of & read & re-read. On the shipping label I found a phone #800-983-7968, I called and talked to some accented person, very hard to understand, very static bad connection call, and this person told me that she would cancel any further shipments, but that I had NOT responded to some email within 14 days to cancel my membership, so therefore she said that was there authorization to send me another supply. So she could not credit me back the $79.96. I told her that I had not received any email & she had said that I did, I then told her I wasn't even looking for an email about any cancellation because there was NOTHING about this in the article that I purchased the product through. I went thru 759 spam mail & found 4 emails from a Acai Burn out of Des Moines, IA. I found nothing from any Acai Berry from Amir and Sanchez Neutraceuticals, LLC.

Other than the fact that this was supposed to be products endorsed by Oprah & RR, the person that the article was about Michelle Thomas & her husband & family live in BLUE EARTH, MN. I asked several people if they knew these people everyone said no. Well guess what, I brought the Ad up again & they now live in AUSTIN, MN. And the new Ad page is the same info only her name is Jeanie Rontero & she lives in BLUE EARTH, MN??

I read & reread all the info on THAT ad, and when I looked everything over on the very last page of the adverstisement in light grey lettering is a *about the free trials working for her and many other people, but the results may vary by person, and about the free trials for free, but there is a shipping fee and some advertisers have terms regarding continued billing after trial expires if you do not cancel. Some advertisers require trial to be canceled within fourteen days, some are 30 days to cancel The Acai and Colon products she recommend usually retail at around $80.00.

I HAD NOTHING LIKE THIS ON THE LAST PAGE of the AD that I printed out. This is exactly what I was looking for and would have NEVER accepted to the $4.95 trial order. I am sure they just added this to their latest ads.

I have emailed Oprah & Rachel Ray to see if they know Amir & Sanchez are SCamming their beloved product. I have contacted the BBB & also work in the Sheriff's Office and have reported this SCAM. I just want to try and help out anyone I can from also being SCAMMED by these jerks.

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

While trying to find out some information about Oprah & Rachel Ray endorsing this website. Oprah has a statement saying that she is not associated or does she endorse any acai berry product or online solicitation of such products. Attorneys for Harpo are pursuing any companies that claim such an affiliation. I am trying to email her to let her know of this company using her name, pictures & etc. thanks,val

Rip Off Report Update, my bank is being VERY supportive and told me that when the shipment comes, just RETURN TO SENDER immediately then notify them at the bank and they will take their next step to recover my loss.
