Don't sign lease purchase option that has anything to do with Lee Michael Amsberry /AKA/ Michael Lee Amsberry. Did business as LMA Properties for several years, in 2003 filed Bankruptcy and is now doing business with a new company name. Possibly Accurate Construction or EZ No Qual Homes.

This is a possible rip off for home seller and/or home buyer. We lost 2 homes because of this man and the way he does business. He seeks out FSBO homes or families that are are having financial difficulties with their properties. Appears as a Property Management Company that pomises to find renters and fully maintain the property. Also will make your monthly payment for you and draw up a contract to purchase your property in 36 months at a profit. Sounds like a great deal.

He just did not make our payment for us even though he was collecting rent from a tenant. Our home eventually went into foreclosure, he went to auction purchased our home for $55,000 less then what he was to pay us, then flipped the property to profit $65,000. He accepted an $8,000 deposit from the tenant, collected $2000 a month from the tenant for 7 months. Over $80,000 profit.

After we began proceeding to go after this crook he filed Bankruptcy under an LLC. And now is doing the same business under a new name. Unsure that we would win anyway. It seems with an LLC after the name the law protects them. It is legal to do this without a real-estate license.

BEWARE if you see this man's name on any documents that you may be signing. He has sales rep's to represent him, so you may never know.

Please be aware that a federal tax lein in the amount of $314,854.58 has been filed against michael amsberry. This is a very telling tale about his business practices, one of many many things he should see jail time for.

Please be aware that Mr. Amsberry has a long history of criminal behavior. A simple search on the INTERNET brings many things to light. Mr. Amsberry was born in Alabama. Using http://criminalsearches.com/ we find he has an several old cases of sexual abuse. I love in his response that he admits that he paid her mortgage late. His promise to all his victims were to pay the mortgage on time every time. He admits he didn't do that. Their past payment history was none of his business, the services he offered were supposed to be a vehicle for them to make ON TIME payments. On time payments mean the money should be receipted by the lender per the loan terms. Not 28 days later. Or a simple search also reveals MANY court cases. This one in particular stands out: http://www.superiorcourt.maricopa.gov/docket/CivilCourtCases/caseInfo.asp?caseNumber=CV2006-004141 I'll quote from the court documents: "NOTE: FRAUD, MISREPRESENTATION CONSPIRACY TO COMMIT FRAUD, BREECH OF CONTRACT/SPECIFIC PERFORMANCE, BREECH OF FIDUCIARY DUTY, DIVERSION AND MISAPPROPRIATION OF FUNDS AND FRAUDULENT CONVEYANCE" The case was dismissed. HMMMM, good business people don't normally get busted for things like this! The icing on the cake is that Michael is now involved with multi-level-marketing schemes. He's got a website I won't link (won't want to help him in any way) that states "Amazing! Discover your own breakthrough network marketing lead generation system you can use to boom ANY MLM business!" Seriously. People involved in MLM schemes are too lazy to actually do REAL business, and scam others in the gray area of the law. Any reputable business exec would laugh at some one trying to back up a MLM scam.

Because of you, Tracy ****, along with Nathaniel Davis and your other co-conspirators, many people lost jobs and others lost lots of money and real estate. I only wish I had been able to afford to sue you all for Slander and Libel in 2003 when you started telling all these LIES to all my 125 customers. I couldn't believe my ears when I heard you and Nathaniel Davis and your other co-conspirators actually invited all my customers to a Seminar hosted by you and an attorney actually not a real attorney as I'll show later in order to Slander me and my company with your LIES! You even tried to get my customers to contribute money to a legal fund to take me to court. You even went so far as to mass produce 20 pages of LIES and distribute this package to all my customers (Libel)! Because of your LIES, many of my customers stopped making their house payments and because of you, they eventually lost their homes. Because of your LIES, my company's income shrank overnight to the point where we had to file for bankruptcy. My company lost $2.5 Million dollars in equity, because of your LIES. Your LIES made it seem like I made a bunch of money off of a lot of people - but I couldn't even afford to hire a good attorney at the time I took the company into bankruptcy, so we lost everything, because of your LIES. Shame on you for doing what you all did: You ruined my company and caused 22 people to lose their jobs because of your LIES! Yes, LIES, because Here's the Truth, folks! In 2002, Tracy and Robert **** owned 2 homes and were behind on their payments on both of them. They could not come up with the money to catch up. I offered to pay them $1500 on each house as a down payment if that would be enough to catch up. They said that would be enough for them to catch up on the payments. I said I would Lease Purchase the property from them with the right to Sub-Lease Purchase to my customers. Dumb me, I believed them: I didn't verify how far behind they were. I found sub-tenent/buyers who started making the payments. 4 months later I had a cash-flow problem and I was 20 days late on making the payment to ****s and IMMEDIATELY the house went into foreclosure! In case you don't know, houses don't go into foreclosure when you're only 20 days late: usually they don't start foreclosure until you're 60 or 90 days behind on payments. So why did the **** homes go into foreclosure so fast? Simple! They LIED to me about how far behind on payments they were! They LIED when they told me my $1500 would allow them to catch up: apparently they were already 2 months behind, so when I paid them 20 days late, it triggered the foreclosure. I told my sub/tenant/buyer, who I will call SMITH to protect their privacy, to stop making payments to me because of the foreclosure, that I would work it out to protect their interests. After all, they had given me $15K Down Payment to purchase the home and I felt obligated to protect their interests. Besides that, in the beginning of my negotiations with Smith for this house, I promised them that if they put $15K down and made all their payments on time, then they would be able to buy the house at the end of 3 years, provided they could get a loan. So in spite of how ****s had screwed everything up, I still had to do everything I could to keep my promise to Smith, because that's the kind of person I am. Naturally, I told Snyders that I would not be making any more payments to them until they caught up on the back payments. They said they had no way to catch up, so I said I would try to work out a "Short Sale" with the bank. I tried to work out a short sale but the lenders were not cooperating at all. In 2003, unlike today, some lenders were choosing just to take the property back in many instances. I thought I was also helping the ****s, because if I could get the bank to accept the Short Sale, then I had a good chance of being able to get the bank to release the ****s from any Deficiency owed. Imagine my surprise, when during the midst of my working on the bank Short Sale, Tracy **** filed an EVICTION against me because I hadn't made the payments. But Tracy, I said to her, YOU cause the houses to go into foreclosure YOU are the reason I'm not making the payments to you at least not until you make up the payments you LIED about! What a LIAR and BACKSTABBER! Ultimately, I was unsuccessful at working out a short sale with the bank, so I was forced to go the bank's trustee's sale. I managed to find a hard-money lender in order to purchase the house so I could keep my promise to Smith. I had to keep bidding up the price to win the auction and when I did win, the other bidders made comments to me indicating I was crazy for paying that much for the house, but I had to keep my promise to the Smith family. I found an investor who would put a permanent loan on the property to pay off the hard money loan. In this entire process, I made no money. Then I let Smith know that the foreclosure problem had been cured and as far as I know, they eventually got a loan and bought the home. TRACY'S LIES: Tracy says I, forced people into foreclosure. This is a big LIE. All I've ever done is try to help people. People have various problems and I find solutions. Deliberately going out to hurt someone is not who I am. I have hundreds of satisfied customers who will attest to that fact. Tracy LIES again when she says her homes went into foreclosure because of me, but it was because she and her husband didn't catch up the payments, even after I gave them an extra $1500 on each house. If I had known they were already 2 months behind on payments, I probably never would have done the deals, given market conditions in 2002. Tracy LIES again when she says I made a big profit. By the time the hard-money lender was paid off and by the time the investor was paid off for putting the permanent loan in place, I wound up with no profit. Furthermore, after Tracy and her co-conspirators of 10 other people forced my company in bankruptcy because they had killed my cash flow, I had to give up all rights to any equity in either of their properties. All together, my company lost over $2.5 Million in equity in 125 houses we controlled. Shame on you Tracy for what you did to all my employees and my family and my children. You will have to answer to God for what you've done. Tracy LIES again when she says I collected rent from the tenant and pocketed the money. In fact, I told the tenant to stop paying me because the house had gone into foreclosure. Tracy LIES again when she says I took my company into bankruptcy to avoid her lawsuit. I took the company into bankruptcy after advice of counsel because we could not pay our bills after Tracy and her co-conspirators killed our cash flow by telling these lies to all my customers. Tracy LIES again when she says she is Unsure if we would win anyway regarding the lawsuit she and her husband filed against me and my company. The truth is that one of the co-conspirators was an attorney who had just passed the bar exam apparently, because when this attorney did present the case against me, while representing one of the other co-conspirators, my attorney told me this guy had obviously never done any trial work because he didn't even know how to try to win any points even if there were any points to win. My attorney and I won that trial and my attorney suggest we file an action against that attorney to get him disbarred because there was no reason to bring the lawsuit in the first place. By the way, defending that lawsuit cost me $10,000. So, the real reason Tracy and Robert **** dropped their lawsuit against me is because they saw how stupid they were for even thinking of suing me when I had done nothing wrong, when my attorney kicked their attorney's butt already over this same stuff. Tracy should be careful about calling someone a crook. If it can't be proved, then Libel and Slander lawsuits can cause Tracy and her husband to lose everything they own. And who knows, maybe someday I will be able to afford an attorney and give these LIARS what they deserve! Funny thing is, everyday this remains posted, the Statute Of Limitations for Libel and Slander is RENEWED! HA! HA! Sincerely Saving Up Money For An Attorney, Michael Lee Amsberry p.s.
