Did you write a check for this payday loan? If you did, be careful because they could take action against you for writing a bad check. It doesn't matter if you had to close your account after you wrote the check.

First, in Texas (where I also live) it is illegal to threaten someone with arrest. Second, no one in this state can arrest you for a debt. Texas is a very consumer friendly state. They won't arrest you, they won't take your car, your house, or come into your house and take your furniture, clothing or anything belonging to you. If they call your work you have the right to tell them to never call again and they must cease. They can, of course, call your house but not at all hours of the night. Most debtors take the threats seriously and pay. They know that and bank on it. That is why collection agencies are so vicious, won't listen to anything and will only demand you pay them. Most people do because they are scared or get tired of the hassles. In fact, unless you gave this creditor something as collateral, i.e., your car title in exchange for the loan, they pretty much can't touch you. Oh they can file a collection lawsuit against you but if you do not own real estate, you are pretty much judgment proof and their own viable means to collect is your desire to keep your credit record clear and your desire to do right and pay your debts. Other than that, they are fish flopping around on the beach without a wave in sight. Rae
